AbstractThis paper examines a new trend in Japan's Official Development Assistance (ODA) policy that emerged at the end of the Cold War. In 1992, the Japanese government adopted the "Official Development Assistance Charter," which obliged Japan to use its foreign aid to promote human rights, democracy, and freedom. Since the beginning of the 1990s, there have been cases when Japan imposed "human rights conditionalities" by increasing the amount of foreign aid to the recipient countries with good human rights records and reducing economic assistance to the countries with poor human rights practices. However, there remain doubts whether Japan is truly committed to use its aid power as leverage to ensure that democracy and human rights are respected by the governments of its aid recipients. This paper uses panel data analysis to examine whether the condition of human rights in aid-recipient countries has become one of the factors that influence Japan's ODA allocation. The findings reveal the lack of evidence to prove that the human rights condition in aid-recipient countries has influenced the allocation of Japanese aid.

AbstractSeveral provisions of the Convention on the Rights of the Child contain references to international cooperation, sometimes in combination with a reference to the needs of developing countries. This article explores whether these references, in light of the interpretation given by the Committee on the Rights of the Child and of other human rights treaties which contain similar wording (in particular the International Covenant on Economic, Social and Cultural Rights and the Disability Convention), amount to a legal obligation to cooperate internationally for development in the field of economic, social and cultural rights. While it is not possible to establish the existence of a legal obligation to provide development assistance in general – which would amount to an extraterritorial obligation to fulfil – legal obligations to respect and protect economic, social and cultural rights of children in third countries do apply. Moreover, the CRC Committee has clarified some specific obligations of fulfilment for donor countries, such as, amongst others, the allocation of 0,7 per cent of GDP to development assistance, and the adoption of a rights-based approach to development cooperation, in which children's rights are mainstreamed.

In 1982 the Netherlands suspended the operation of a treaty between Surinam and the Netherlands which obliges the Netherlands to render development assistance to Surinam. This was justified by invoking a fundamental change of circumstances: a coup d'etat which destroyed democracy and led to serious human rights violations. Bosma examines both substantive and procedural aspects of the suspension and concludes that the Netherlands did not correctly invoke a fundamental change of circumstances.

With a strong economy and newly acquired confidence following three decades of rapid economic expansion, China has pursued an outward looking policy based upon foreign direct investment, development assistance and trade targeting particularly the developing world. Such expansion has drawn concerns over its impact on human rights, democratization and the environment. This paper assesses these concerns by examining Sino-Cambodia relations over the past sixteen years. It concludes that while trade, development assistance, and investment have had positive effects on Cambodia’s economic development, concerns that these engagements have derailed deeper democratization in Cambodia are not deterministic. Cambodia’s authoritarian trajectory is less a product of China’s engagement and more of the Cambodian elites’ defiance of Western efforts at democratic promotion and belief in state developmentalism—economic prosperity with tight political control.
