An appendix to Mr. Ware’s paper on vision

The author remarks, that Mr. Ware’s observations with regard to short-sightedness, being in general merely the consequence of habit acquired at an early age, is conformable with his own experience in general, and that he himself is a particular instance of natural long-sightedness gradually converted into confirmed short sight. He very well remembers first learning to read, at the common age of four or five years, and that at that time he could see the usual inscriptions across a wide church; but that at the age of nine or ten years he could no longer distinguish the same letters at the same distance, without the assistance of a watch-glass, which has the effect of one slightly concave. In a few years more the same glass was not sufficiently powerful; but yet his degree of short-sightedness was so inconsiderable, that he yielded to the dissuasion of his friends from using the common concave glasses till he was upwards of thirty years of age, when No. 2 was barely sufficient; and he very shortly had recourse to No. 3. In the course of a few years an increase of the defect rendered it necessary for him to employ glasses still deeper, and his sight soon required No. 5, where it has remained stationary to the present time. From the progress which Sir Charles Blagden has observed in his own short-sightedness, he is of opinion that it would have been accelerated by an earlier use of concave glasses, and might have been retarded, or perhaps prevented altogether, by attention to read and write with his book or paper as far distant as might be from his eyes. In this communication he takes the same opportunity of adding an experiment made many years since on the subject of vision, with a view to decide how far the similarity of the images received by the two eyes contribute to the impression made on the mind, that they arise from only one object. In the house where he then resided, was a marble surface ornamented with fluting, in alternate ridges and concavities. When his eyes were directed to these, at the distance of nine inches, they could be seen with perfect distinctness. When the optic axes were directed to a point at some distance behind, the ridges seen by one eye became confounded with the impression of concavities made upon the other, and occasioned the uneasy sensation usual in squinting. But when the eyes were directed to a point still more distant, the impression of one ridge on the right eye corresponded with that made with an adjacent ridge upon the left eye, so that the fluting then appeared distinct and single as at first, but the object appeared at double its real distance, and apparently magnified in that proportion. Though the different parts of the fluting were of the same form, their colours were not exactly alike, and this occasioned some degree of confusion when attention was paid to this degree of dissimilarity.

Mr. F. J., the subject of the present memoir, is the son of a physician; of scrofulous diathesis, but otherwise of robust constitution; of irritable temperament, but of contented and happy disposition; and endowed with an excellent understanding, quick power of conception, and retentive memory. In both the eyes of his father, cataract (with the addition, I suspect, of glaucoma) has manifested itself within the last four years, after a severe attack of influenza. The relatives on the paternal side are predisposed to diseases of the eye, but in the mother, and in the relatives on her side, no such predisposition can be traced. With regard to the cause of the ophthalmic affections which form the subject of this paper, the mother seemed to lay much stress on the following circumstance, which, although it may possibly have had some share in the cause of one of them, can have had no influence, in my opinion, in producing the other. She stated to me that in the eighth month of her pregnancy, which up to this period had proceeded favourably, she received from her youngest child, which she was carrying in her arms, a severe blow on the eye. This accident caused inflammation of the eye, accompanied with a curious visual illusion, viz. that all objects which she saw, but especially those situated on the ground, appeared of a deep concave form; an illusion which lasted for several months. The fright experienced from the accident also brought on convulsions, which, recurring several times, extended even to the fœtus. The recurrence of these convulsions produced in the mind of the mother a continual anxiety and fear for the health of the child, while the pain arising from the ophthalmia, together with the visual illusion just mentioned, gave her fears a direction more especially towards its eyes. Delivery took place at the proper period, when the eyes of the infant, which was otherwise healthy and well-formed, were found to present a twofold defect of organization. The father, to whose statement, on account of his professional knowledge, more weight is to be attached, informed me that both eyes were turned inwards to such an extent that a portion of the cornea was hidden by the inner canthus, and that in both pupils a yellowish-white discoloration was to be observed, which, being situated behind the iris, could not be the pupillary membrane. That the strabismus and cataract of both eyes in this case were congenital, is evident from the testimony both of the parents and of the nurse, whom I have closely questioned on this subject. The latter, who can distinctly remember all the circumstances of the case, told me that when the child was a few months old, she held a light before its eyes, of which it took no notice. I ascertained also from her that the eye-balls had not that restless motion which is generally observed in those who are born blind, but that both eyes were always turned inwards, and that but rarely either the one or the other was moved from the internal canthus. It was also stated to me, that towards the end of the second year the operation of keratonyxis was performed on the right eye, upon which a severe iritis ensued, terminating in atrophy of the eye-ball. Within the next four years two similar operations were performed on the left eye, which did not indeed destroy the organ, but at the same time did not remove the opacity in the pupil. The colour of the opacity became in time, however, of a clearer white; and the patient acquired a certain sensation of light, which he did not seem to have had before the operation. Both eyes for a long time retained a disposition to inflammation, and suffered repeatedly from conjunctivitis, whence the vessels of the conjunctiva were increased in number and size to such an extent, that it was necessary they should be several times excised.

The necessity of discussing so great a subject as the Theory of the Vertebrate Skull in the small space of time allotted by custom to a lecture, has its advantages as well as its drawbacks. As, on the present occasion, I shall suffer greatly from the disadvantages of the limitation, I will, with your permission, avail myself to the uttermost of its benefits. It will be necessary for me to assume much that I would rather demonstrate, to suppose known much that I would rather set forth and explain at length; but on the other hand, I may consider myself excused from entering largely either into the history of the subject, or into lengthy and controversial criticisms upon the views which are, or have been, held by others. The biological science of the last half-century is honourably distinguished from that of preceding epochs, by the constantly increasing prominence of the idea, that a community of plan is discernible amidst the manifold diversities of organic structure. That there is nothing really aberrant in nature; that the most widely different organisms are connected by a hidden bond; that an apparently new and isolated structure will prove, when its characters are thoroughly sifted, to be only a modification of something which existed before,—are propositions which are gradually assuming the position of articles of faith in the mind of the investigators of animated nature, and are directly, or by implication, admitted among the axioms of natural history.

I have for some time entertained an opinion, in common with some others who have turned their attention tot he subject, that a good series of observations with a Water-Barometer, accurately constructed, might throw some light upon several important points of physical science: amongst others, upon the tides of the atmosphere; the horary oscillations of the counterpoising column; the ascending and descending rate of its greater oscillations; and the tension of vapour at different atmospheric temperatures. I have sought in vain in various scientific works, and in the Transactions of Philosophical Societies, for the record of any such observations, or for a description of an instrument calculated to afford the required information with anything approaching to precision. In the first volume of the History of the French Academy of Sciences, a cursory reference is made, in the following words, to some experiments of M. Mariotte upon the subject, of which no particulars appear to have been preserved. “Le même M. Mariotte fit aussi à l’observatoire des experiences sur le baromètre ordinaire à mercure comparé au baromètre à eau. Dans l’un le mercure s’eléva à 28 polices, et dans Fautre l’eau fut a 31 pieds Cequi donne le rapport du mercure à l’eau de 13½ à 1.” Histoire de I'Acadérmie, tom. i. p. 234. It also appears that Otto Guricke constructed a philosophical toy for the amusement of himself and friends, upon the principle of the water-barometer; but the column of water probably in this, as in all the other instances which I have met with, was raised by the imperfect rarefaction of the air in the tube above it, or by filling with water a metallic tube, of sufficient length, cemented to a glass one at its upper extremity, and fitted with a stop-cock at each end; so that when full the upper one might be closed and the lower opened, when the water would fall till it afforded an equipoise to the pressure of the atmo­sphere. The imperfections of such an instrument, it is quite clear, would render it totally unfit for the delicate investigations required in the present state of science; as, to render the observations of any value, it is absolutely necessary that the water should be thoroughly purged of air, by boiling, and its insinuation or reabsorption effectually guarded against. I was convinced that the only chance of securing these two necessary ends, was to form the whole length of tube of one piece of glass, and to boil the water in it, as is done with mercury in the common barometer. The practical difficulties which opposed themselves to such a construction long appeared to me insurmount­able; but I at length contrived a plan for the purpose, which, having been honoured with the approval of the late Meteorological Committee of this Society, was ordered to be carried into execution by the President and Council.

Psychiatric disorders’ or as emphasized in the paper in the form of somatic-symptom disorder, a sub-category of Schizophrenia has been from the ancient of the human civilization, when the medicinal approach and treatment of the subject hasn’t been developed yet, the notion of the affected subject to be under some spiritual subjugation has automatically been implied on the minds of the people which leads to immense torture and torment of the subject by the society. However, in the modern medical scenario, the situation has shifted from spiritual/evilness to the extreme derision where it has been already implied on the healthy societies brain that, the subject is intentionally acting like a patient or it’s a ‘disease of the mind’ with no associated physical pain which being attributed to the tendency of late diagnosis and recovery, makes the subject a sheer block of ‘sarcasm’ among the healthy society where they tries their best to make ‘the fun out of him’ as regards to his continuous pain and suffering. This generally amplified by the delay in the starting of the treatment for the difficulty of the doctors to diagnose the disease, as not so developed instruments are still in their infancy to detect and derelict the mental disorders, where in most of the time, the golden period of diagnosis is either over or even if psychiatric treatment is initiated can lead to a more defocused effects as doctors itself finds it difficult to approach the right medicine to the disordered person, where, in case, they have to go from one doctor to another in the risk of a trial and error effect.

In life, it often happens that humans take different actions on different occasions to save man or his wealth. These actions can be taken when there is a need to protect the integrity of man and his wealth, both individual and social wealth. Man performs these actions morally and without any institutional obligation. Man does the action without consent in order to save one's life or another's wealth. There is a need for such an action, because everyone sometimes in certain cases needs mutual help. With these behaviors of people, it is seen that they do not take these actions out of legal obligation, but act and should act with the consciousness and conscience of the civilized man. People who do this are driven by the need for cooperation, humanity, existence at the expense of the other, namely society. A person performs this action by perpetrating the work of another without consent for any other person. Hence, they undertake some factual and legal action for the other, sacrificing something that can be the property value and their bodily integrity. Sometimes this action must be taken because there are actions that cannot be postponed, therefore someone should take an action in such situations even when uninvited. Years ago, a curator at the Smithsonian Institution said to me, “Scientists and engineers are nutty on the subject of priority.” That was before I realized just how far-reaching that nuttiness was or how misguided the very concept of priority is. As an example, try searching out the inventor of the telephone. Instead of Alexander Graham Bell, you may get the name of a German, Johann Philipp Reis. The common wisdom is that Reis invented a primitive telephone that was only marginally functional, while Bell’s phone really worked. Reis was a twenty-six-year-old science teacher when he began work on the telephone in 1860. His essential idea came from a paper by a French investigator named Bourseul. In 1854 Bourseul had explained how to transmit speech electrically. He wrote: . . . Speak against one diaphragm and let each vibration “make or break” the electric contact. The electric pulsations thereby produced will set the other diaphragm working, and [it then reproduces] the transmitted sound. . . . Only one part of Bourseul’s idea was shaky. To send sound, the first diaphragm should not make and break contact; instead it should vary the flow of electricity to the second diaphragm continuously. While Reis had used Bourseul’s term “make or break,” his diaphragm actually drove a thin rod to varying depth in an electric coil. Instead of making and breaking the current, he really did vary it continuously. Bell faced the same problem when he began work on his telephone a decade later. First, he used a diaphragm-driven needle that entered a water-acid solution to create a continuously variable resistance and a smoothly varying electrical current. Bell got the idea from another American, inventor Elisha Gray. Of course, a liquid pool comes with two problems. One is evaporation; the other is immobility. Bell soon gave it up in favor of a system closer to Reis’ electromagnet. Still, it is clear that Gray’s variable-resistance pool had pointed the way for Bell. Next we must ask whether Bell was influenced by Reis’ invention. Reis died two years before Bell received his patent. (He was only forty, and he never got around to seeking a patent of his own.)

This chapter focuses on breach of condition. The first situation in which termination will be available is where the other party has broken a ‘condition’. A condition is a stipulation in a contract, be it a contract of sale or some other contract, the breach of which gives rise to the right to ‘treat the contract as repudiated’. When is a term a ‘condition’? A term can be made a condition either by express stipulation or by implication. The chapter then distinguishes condition from various other concepts with which it may appear to have similarities, but which work in different ways. It also looks at time stipulations and the divergent approaches of the common law and equity to time stipulations.

Abstract The extent to which members of the clergy are considered ‘employees’ for the purposes of secular employment and equality legislation has been the subject of much discussion, but essentially remains a fact sensitive question. The Equality Act 2010 (‘the 2010 Act’) seeks to prevent discrimination on the basis of nine ‘protected characteristics’. While recognizing that the application of the 2010 Act to the variety of clergy offices is ‘not straightforward’, the Church of England (‘the Church’) has opined that an equitable approach to clergy appointments is to proceed as if they were subject to the provisions of the 2010 Act. What follows is in`tended to be a thorough review of the eligibility criteria for clergy appointment in the Church to assess their compatibility with the requirements of the 2010 Act. In addition, particular consideration will be given to Schedule 9(2) to the 2010 Act which makes specific provision relating to religious requirements concerning the protected characteristics of sex, sexual orientation, and marriage and civil partnership. In short, where the employment is for the purposes of an organized religion, such as the Church, requirements which relate to these protected characteristics will not constitute discrimination where they engage the ‘compliance or non-conflict principle’. What these principles mean and how they might operate in practice is discussed below, taking into account the likely canonical and theological justifications for discriminating against certain individuals. Whether the law strikes the right balance between, on the one hand protecting clergy and, on the other, providing the Church with the autonomy to act in accordance with its established doctrine, will be explored in the final analysis.

It is well-known how, in the spring of 1877, the German explorers at Olympia had the good fortune to dig up the chief parts of a statue which had been seen by Pausanias in the same spot, and had been described by him in the following words:—χρόνῳ δὲ ὕστερον καὶ ἄλλα ἀνέθεσαν ἐς τὸ Ἡραῖον, Ἑρμῆν λίθου, Διόνυσον δὲ φέρει νήπιον, τέχνη δέ ἐστι Πραξιτέλους (Paus. v. 17, 3).The bulk of the statue is in exquisite preservation. The greater part however of the right arm of Hermes is missing. Since the whole motive of the subject depends upon the action of the arm, speculation has been busy as to the most probable restoration of this limb.With a view to the solution of this problem, Benndorf has collected together a series of types of the Hermes and Dionysos group. His list is not exhaustive, and he seems to have passed over certain instances of importance.My principal object in this paper is to attempt to show that a certain group of types contains the clue to the restoration of the missing arm, although they do not represent the arm in its true position; and on the other hand to show that certain types which have the arm in its true position, are untrustworthy guides as to the restoration of the attribute attached to it.

David Hume’s critique of religion reveals what seems to be a vacillation in his commitment to an argument-based paradigm of legitimate believing. On the one hand, Hume assumes such a traditional (argumentbased) model of rational justification of beliefs in order to point to the weakness of some classical arguments for religious belief (e.g., the design argument), to chastise the believer for extrapolating to a conclusion which outstrips its evidential warrant. On the other hand, Hume, ‘mitigated’ or naturalist skeptic that he is, at other times rejects an argumentbased paradigm of certainty and truth, and so sees as irrelevant the traditional or ‘regular’ model of rational justification; he places a premium on instinctive belief, as both unavoidable and (usually) more reliable than reasoning. On this view, a forceful critique of religion would have to fault it, not for failing to meet criteria of rational argument (failing to proportion belief to the evidence), but (as Hume sometimes seems to) for failing to be the right sort of instinct.
