Making the future by using the future: A study on influencing privacy protection rules through anticipatory storylines

This article investigates how futures of privacy protection are made in Europe. The public consultation phase of the European Union’s data protection reform is analysed as a case of making the future by using the future, that is, influencing institutional change through anticipatory storylines. A qualitative analysis of consultation responses is conducted, and two discourse coalitions are identified. The industry coalition promotes market liberalisation to allow the digital future to emerge. The civil society coalition, in turn, argues for rescuing privacy with strict rules. The article suggests that plausibility in relation to the discursive and extra-discursive environment is crucial for the success of storylines. The second storyline was relatively successful because it was more plausible in light of the trend of legalism and the predominant future-oriented narrative of privacy in danger. The ‘anticipatory institutionalism’ approach opens novel perspectives concerning actors’ future-oriented projects in relation to historical processes.

The offshore project proposal (OPP) process was introduced in 2014 as part of the streamlining of regulatory processes under the Offshore Petroleum and Greenhouse Gas Storage Act 2006 and Environment Protection and Biodiversity Conservation Act 1999 to provide for offshore petroleum developments to be assessed early in the project lifecycle. The OPP process involves the assessment of environmental impacts and risks of petroleum activities conducted over the life of an offshore project by the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA). An OPP for an offshore project must be accepted by NOPSEMA before a titleholder can submit environment plans for activities that make up the offshore project. Although the OPP process is not new, it has proven complex to navigate, with four revisions to the OPP contents requirements guideline published by NOPSEMA since inception, and only three OPPs reaching the public consultation stage to date. An OPP is required to describe the offshore project; describe the environment that may be affected by the project; set out environmental performance outcomes for the project; describe feasible alternatives to the project or its activities; and evaluate environmental impacts and risks of the project. This paper provides insight to the OPP drafting, submission and assessment process, with shared key learnings based on actual examples of OPP submissions made. In particular, we will focus on the crucial elements that haven proven to make an OPP submission effective, including project aspect scoping, understanding relationships between aspects and receptors, building flexibility within set project boundaries and demonstrating acceptability.

This article explores the political controversy surrounding the proposed Northern Gateway bitumen pipeline by analyzing the modalities through which elite rationalities structure public news discourse. First, through a news analysis, the authors identify the most common pro-approval actors cited speaking in favour of the project. Next, they identify the most prominent pro-approval civil society sources and ascertain their level of embeddedness in conservative discourse coalitions. Finally, the authors identify the dominant framing techniques that disproportionately structure the public discourse around the Gateway project. The article ultimately argues that over-reliance on “official sources,” the prominence of industry-backed civil society organizations, and the influence of hegemonic discourses on journalistic practice all conspire to structure the public discourse on Northern Gateway in favour of elite preferences and rationalities.Cet article explore la controverse politique entourant l’oléoduc de bitume proposé par Northern Gateway en analysant les modalités selon lesquelles les rationalités d’élites structurent le discours tenu dans les médias d’information. D’abord, au moyen de l’analyse de nouvelles, les auteurs identifient les acteurs appuyant l’oléoduc que les médias citent le plus souvent. Ensuite, ils identifient les sources de la société civile les plus en vue et évaluent leur degré d’appartenance à des coalitions conservatrices. Enfin, les auteurs identifient certaines techniques de cadrage qui jouent un rôle disproportionné dans la structuration du discours public à l’égard du projet Gateway. Cet article se conclut en soutenant qu’une dépendance excessive envers des « sources officielles », la centralité d’organismes de la société civile appuyés par l’industrie, et l’influence de discours hégémoniques sur la pratique journalistique coïncident pour structurer le discours public sur Northern Gateway en faveur de préférences et de rationalités d’élites.

The subject of Disability and Sickness benefits in conjunction with Life Assurance is of recent growth. The only occasions when the Members of the Institute have had the matter before them appears to have been in 1911 when a paper was read by W. C. Fielder before this Society, and in 1924 when a discussion took place at one of the General Meetings of the Institute.The immense strides that have been made in America in the last five years, and the latent interest aroused in this country, as reflected by the amount which has been written in Insurance publications will, I hope, justify a discussion of the subject once more.It will not be out of place to quote the following from a recent number of The Review:“The attitude of British Actuaries on this question (Sickness and Disability benefits) is perhaps best described as one of neutrality. Were circumstances to force them to a decision for, or against, it would seem probable that many would be antagonistic. In the meantime, so long as they are not forced into open hostility they are prepared to ignore the business as much as possible. This is, of course, no more than an impression gathered from conversations here and there, and odds and ends of information that have come to hand from time to time. We imagine, however, that it comes fairly near to being an accurate statement of the case. If that be so then we can but regret it. The value of Disability Insurance to the public is so great, the amount of suffering it could eliminate so large that were Actuaries busily engaged in searching for the means of making it universally available the middle classes might look to the future with greater confidence.”

In the paper the results of research titled Cultural Institutions during COVID-19. Museum Strategies for Reaching the Public are presented. It was conducted by the Forum of Museum Educators as commissioned by the National Institute for Museums and Public Collections (NIMOZ). The main purpose was to show the impact of the pandemic on the operations of museums after 12 March 2020 when the decision was made in Poland to close the culture sector to the public; the aim was also to diagnose and analyse problems that the pandemic caused, and to point to the directions of impact on cultural institutions possible in the future, namely after restoring ‘normality’. The perspective adopted in the research, i.e., institutional and individual one, enables a multifaceted analysis of the processes initiated by museums in response to unclear and often complicated mechanisms of the new pandemic reality, which still today, some dozen months since its outbreak, continues for museums the source of challenges as far as logistics and financing issues are concerned.

The problem raised in this research is the implementation of ERP (Electronic Road Price) which will be applied in several street corners of the capital of Jakarta, many pros and cons that will occur in its application, ranging from its licensing to its application in the field, socialization to users the road in the capital is very important to do because it will directly intersect with motorized motorists in the capital of Jakarta, in its application also must be considered using what tools are best placed in every corner of the capital to help smooth the system to be applied, in this research the author will provide suggestions and frameworks so that the implementation of the ERP system (Electronic Road Price) can be carried out right away, with the suggestions that have been made are expected to influence the policies that will be made in terms of ERP (Electronic Road Price) in the future.

The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological).The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation.Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections.

The article is devoted to the research of goals and functions of lobbying activity. The author has processed the ideas of domestic and foreign scientists, proposed his own approaches to the definition of goals and functions of lobbying activities through the prism of public administration. As a result, a generalized vision of the goals and functions of lobbying activities as interrelated elements of the lobbying system was proposed, and a forecast for further evolution of the goals and functions of domestic lobbying was provided. The analysis of lobbying functions allowed us to notice the tendencies in shifting the goals of this activity. If the objectives were fully covered by functions such as mediation between citizens and the state, the information function and the function of organizing plurality of public interests, then the role of strengthening the self-organization of civil society and the function of compromise become increasingly important in the process of formation in the developed countries of civil society and the development of telecommunication technologies. Ukrainian lobbyism will not be left to the side of this process. Already, politicians of the highest level, leaders of financial and industrial groups have to act, adjust their goals (even if they are — declared), taking into account the reaction of the public. In the future, this trend will only increase. The analysis of current research and political events provides all grounds for believing that, while proper regulatory legislation is being formed in Ukraine, the goals and functions of domestic lobbying will essentially shift towards a compromise with the public. It is noted that in spite of the existence of a basic direction of action, lobbying may have several ramified goals. Guided by the goals set, lobbyism can manifest itself in various spheres of the political system of society, combining the closely intertwined interests of various actors in the lobbying process, or even — contrasting them.
