The similarity analysis of Port State Control regimes based on the performance of flag states

Port State Control inspections play a paramount role in the enhancement of maritime safety. Port State Control regimes were established to ensure sustainability of Port State Control inspections. There are a total of 10 Port State Control regimes. Although all of these Port State Control regimes inspect foreign flag ships calling on their ports in compliance with international maritime safety and pollution regulations, still different implementations exist between these Port State Control regimes. According to the detentions, 73% of flag states have different performances in Port State Control regimes. However, the uniformity in inspections and detentions is quite important in the improvement of the effectiveness of Port State Control inspections in the world. This study aims at assessing the similarities between the Port State Control regimes on the basis of the performance of flag states as regards their Port State Control inspections. The similarities of the Port State Control regimes are analyzed employing the hierarchical clustering method using the detention and deficiency rates similarity matrices, the risk levels similarity matrices of flag states, and the combined similarity matrix. Accordingly, similarities between Port State Control regimes are discussed relative to each other and the Paris memorandum of understanding.

The Turkish Straits are well known for theirs intensive maritime traffic. The average annual number of transit ships passing through this waterway is approximately 50000 and more than 100 flag states pass through it. Moreover, this waterway presents a navigational challenge owing to its inherent geographic and oceanographic characteristics. Also, sub-standard ships navigating in this region lead to an increased risk levels and pose a threat to the marine environment. Over the years, serious maritime accidents occurring in the straits region had resulted in losses of life and constituted environmental disasters. The high risk arising from maritime shipping in these regions had always endangered public health in the vicinity of the Turkish Straits. In this study, maritime safety in the Turkish Straits region had been assessed based on the performance in the Port State Control inspections of flag states passing through this region. For the assessment of the performance of passing flag states, detention and deficiency indices of these flag states were generated for the MOUs. According to these values, the risk level of these flag states had been determined by the weighted risk point methods. Hereby, in addition to the determination of the risk level of flag states, the relationships between the inspections of MOUs had been also discussed on the basis of both the detention and the deficiency rates of flag states.

Abstract The principle that a ship is subject to the exclusive jurisdiction of the flag State on the high seas is firmly established. But given the prevalence of open registries and the multiple challenges in the maritime sphere, such as maritime safety, the popularity of cruise holidays, the promotion of human rights for those working at sea, and the need to combat iuu fishing, is it any longer tenable to slavishly follow the principle? International instruments and judicial decisions have emphasised the responsibilities of flag States. But States have also increasingly turned to other mechanisms, especially port State control, to deal with the various problems.

The aim of this paper is to analyze the available data on recorded ship deficiencies during ship inspections which are related to pollution prevention. The purpose of these inspections regulated under the different Port State Control (PSC) regimes’ Memorandum of Understanding (MoUs), is to detect and disable the operation of substandard ships. The data obtained were sorted according to the six Annexes of the International Convention for the Prevention of Pollution from Ships (MARPOL) Convention, and a comparison was made within the scope of each Memorandum of Understanding by each of the Annexes and antifouling system. By using a Chi-Squared test and correlation analysis, MoUs are compared and analyzed. The conclusions thus obtained provide an insight into the most common deficiencies regarding pollution prevention in the world fleet, revealing which standards are most often met and which are trying to achieve a better degree of compliance with the standards envisaged by law.

Abstract Background The Maritime Labour Convention, 2006 (MLC2006) entered into force in August 2013 and is a milestone for better working and living conditions (WLC) for seafarers. As of March 2020, 96 countries have ratified the MLC2006, covering more than 90% of the world’s shipping fleet. A system of port state control (PSC) allows ratifying countries to inspect any foreign ship arriving in their ports for compliance with the convention. It is intended as a second safety measure for the identification of substandard ships that sail all over the world. Nine regional agreements, so-called Memoranda of Understanding (MoU), have been signed to coordinate and standardize PSC inspections and to increase efficiency by sharing inspections and information. This paper uses public PSC statistics to evaluate the impact of the MLC2006. Methods A preliminary analysis using registered tonnage and MLC2006 ratification was conducted and seven MoU were selected for the analysis. The annual reports of these MoU have been viewed in September 2019. Numbers on annual inspections, deficiencies and detentions and in particular data for deficiencies related to living and working conditions and certificates and documents, have been extracted and analyzed for the years 2010 to 2017. Results Across the eight-year period analyzed, inspection numbers remained stable among all MoU authorities. Deficiencies overall and deficiencies related to WLC declined, indicating an improvement in conditions overall and an increased focus on seafarers’ conditions on board. After the MLC2006 entered into force, three MoU reported WLC-ratios above 14%, while the numbers didn’t rise above 10% in the other four authorities. Deficiencies related to certificates and documents did not rise significantly between 2010 and 2017. Two European MoU showed the highest ratios for deficiencies in both categories analyzed. Conclusion The analysis confirmed that an increasing attention is being paid to the inspection of working and living conditions, especially in European countries. However, a clear positive impact of the MLC2006 could not be determined from the PSC statistics in this analysis. A large variation still exists among the MoU, a fact that demands increased efforts for harmonization of PSC procedures.

AbstractA new clustering method for random intervals that are measured in the same units over the same group of individuals is provided. It takes into account the similarity degree between the expected values of the random intervals that can be analyzed by means of a two-sample similarity bootstrap test. Thus, the expectations of each pair of random intervals are compared through that test and a p-value matrix is finally obtained. The suggested clustering algorithm considers such a matrix where each p-value can be seen at the same time as a kind of similarity between the random intervals. The algorithm is iterative and includes an objective stopping criterion that leads to statistically similar clusters that are different from each other. Some simulations to show the empirical performance of the proposal are developed and the approach is applied to two real-life situations.

Abstract Introduction The merchant marine fleet is under inspection by several parties to ensure maritime regulation compliance. International Maritime Organization mainly regulates the industry, and the most effective defender is indeed Port StateControl run by the regional memorandum of understandings. Objective This article aims to analyze all detention remarks of Paris Memoranda of Understanding (MOU) from 2013 to 2019 for EU15 countries (except Luxemburg and Austria) to guide marine industry on detainable Port State Control remarks and country risk profile. Methods The data of the detained vessels taken from the public website of Paris MOU and each report considered as a professional judgment that causes detention. Analytical Hierarchy Process Approach has been utilized to indicate the ranking of basic maritime regulations from the perspective of the Port State Control, and Geographic Information System (GIS) helps us to demonstrate the regional dispersion amongst EU15. Results Through an approach based on Analytical Hierarchy Process and demonstrating the results on GIS has been shown that almost all the country’s top priorities for regulation are Safety of Life at Sea (SOLAS) and Fire Safety Systems (FSS). Moreover, a comparative demonstration of the detention percentage of each regulation to AHP results demonstrates a better understanding of EU15 countries' detention profile. Conclusion The results of the study can assist Port State Officers, ship crew, ship owners, and managers in presenting the facts of their inspection and able to improve themselves. The spatial analysis is also expected to guide ship owners and managers to focus their vessel’s deficiencies on preventing sub-standardization. Policymakers also utilize these reports to evaluate their inspection practices.

AbstractCOVID-19 has widely spread around the world, impacting the health systems of several countries in addition to the collateral damage that societies will face in the next years. Although the comparison between countries is essential for controlling this disease, the main challenge is the fact of countries are not simultaneously affected by the virus. Therefore, from the COVID-19 dataset by the Johns Hopkins University Center for Systems Science and Engineering, we present a temporal analysis on the number of new cases and deaths among countries using artificial intelligence. Our approach incrementally models the cases using a hierarchical clustering that emphasizes country transitions between infection groups over time. Then, one can compare the current situation of a country against others that have already faced previous waves. By using our approach, we designed a transition index to estimate the most probable countries’ movements between infectious groups to predict next wave trends. We draw two important conclusions: (1) we show the historical infection path taken by specific countries and emphasize changing points that occur when countries move between clusters with small, medium, or large number of cases; (2) we estimate new waves for specific countries using the transition index.
