Hate Speech: A Call to Principles

The authors review the history of First Amendment rulings as they relate to speech codes or other regulations whose prohibitions are directed at the content of speech. A case study, based on an experience at Trenton State College, details the legal constraints, principles, and practices that Student Affairs administrators should be aware of when confronted with such situations.

The striking down of the Stanford University Hate Speech Code on February 27, 1995 demonstrated the strong animus in U.S. First Amendment decisions against such codes. Judge Peter Stone, applying the U.S. Supreme Court decision in R.A.V. ruled, first, that the Stanford Code was too broad, and second, that the state cannot censor content by picking out some "fighting words" to prohibit. I argue that the moral basis for banning overbroad codes combines a nonconsequential emphasis on the value of liberty with a consequentialist analysis of what happens when liberty that should be protected is entangled in codes reflecting liberty that should not be protected. In contrast, the moral basis for content neutrality does not depend on consequentialist thinking, but shows that the very search for a moral basis for banning the purest acts of hateful speech logically makes the speech protected by elevating it to a viewpoint.

This article demonstrates how civil liberties lawyers’ efforts to address the complaints of imprisoned people in the 1970s inadvertently helped provide state attorneys with tools they used to stymie prisoners’ organizing efforts. Using North Carolina as a case study, I explain why a diverse range of legal actors—including civil liberties lawyers, federal judges, and state attorneys—supported the creation of prison grievance procedures. I then reveal how state attorneys successfully used them, once implemented, to argue that because the procedures offered a seemingly fair, institutional avenue for imprisoned people to express their grievances, prison administrators could ban prison organizing without violating prisoners’ First Amendment rights to free speech and assembly. The history of prison grievance procedures, I suggest, highlights the limits of constitutional rights litigation for achieving social change, offers a new approach to the study of legal endogeneity, and helps explain the demise of the prisoners’ rights movement.

Few issues are more important or more critical to student affairs administrators than violence and mediation. Violent acts--date rapes, physical assualts, hate speech and crimes--shred the invisible tapestry (Kuh & Whitt, 1988) or norms, values, practices, beliefs and assumptions that shape the behavior of individualts and groups in a collegiate setting.

This chapter explores movement and circulation across the Mediterranean and seeks to contribute to a history of proto-nationalism in the Maghrib and the Middle East at a particular moment prior to World War I. The discussion is particularly concerned with the interface of two Mediterranean spaces: the Middle East (Egypt, Ottoman Empire) and North Africa (Morocco), where the latter is viewed as a case study where resistance movements sought external allies as a way of compensating for their internal weakness. Applying methods developed by Subaltern Studies, and linking macro-historical approaches, namely of a translocal movement in the Muslim Mediterranean, it explores how the Egypt-based society, al-Ittihad al-Maghribi, through its agent, Aref Taher, used the press as an instrument for political propaganda, promoting its Pan-Islamic programme and its goal of uniting North Africa.

Immediately after the Second World War Sweden was struck by a wave of sightings of strange flying objects. In some cases these mass sightings resulted in panic, particularly after authorities failed to identify them. Decades later, these phenomena were interpreted by two members of the Swedish UFO movement, Erland Sandqvist and Gösta Rehn, as alien spaceships, or UFOs. Rehn argued that ‘[t]here is nothing so dramatic in the Swedish history of UFOs as this invasion of alien fly-things’ (Rehn 1969: 50). In this article the interpretation of such sightings proposed by these authors, namely that we are visited by extraterrestrials from outer space, is approached from the perspective of myth theory. According to this mythical theme, not only are we are not alone in the universe, but also the history of humankind has been shaped by encounters with more highly-evolved alien beings. In their modern day form, these kinds of ideas about aliens and UFOs originated in the United States. The reasoning of Sandqvist and Rehn exemplifies the localization process that took place as members of the Swedish UFO movement began to produce their own narratives about aliens and UFOs. The question I will address is: in what ways do these stories change in new contexts? Texts produced by the Swedish UFO movement are analyzed as a case study of this process.

Stanley Levy and Charles Kozoll capture much of the complexity of decisionmaking and offer an important contribution to our understanding of this perplexing topic. The publication of A Guide to Decision Making in Student Affairs: A Case Study Approach, furthermore, is timely due to what Stage (1993) recognizes as an increasing expectation that "new professionals, even at the lowest levels, have the ability to work independently and solve complex issues knowledgeably and with skill and integrity" (p. iii). The case study approach combined with the expert advice of 15 seasoned student affairs deans (called informants) provides a valuable resource for learning about a central task in our profession. The book offers students as well as experienced professionals background information critical to decisionmaking in higher education, exploration of fundamental issues that influence the process, carefully constructed and relevant case studies, and a reservoir of advice from some of the most well respected senior-level practitioners in our field. This book is particularly valuable to faculty members facilitating learning with new professionals, but it is a resource most student affairs professionals would find well worth owning.
