ABSTRAKKewenangan Pemerintah Daerah Terhadap Zonasi Pengelolaan Wilayah Pesisir Dan Pulau-pulau Kecil Di Provinsi Kalimantan Utara oleh Nurul Ridwan Yusuf dan dibimbing oleh Dr. Marthen B. Salinding, S.H., M.H dan Dr. Marthin Balang., S.H., M.Hum. Dalam penelitian ini, rumusan masalah yang diangkat antara lain: 1. Kewenangan Pemerintah Daerah dalam Mengelola Sumberdaya Perikanan, 2. Upaya Pemerintah Daerah dalam meminimalisir konflik Pengelolaan Sumberdaya Perikanan di Provinsi Kalimantan Utara. Penelitian ini bertujuan untuk menguji secara normatif dan mengkaji isu hukum menggunakan prinsip hukum serta dengan menggunakan metodologi pendekatan peraturan perundang-undangan (statue approach) dan pendekatan kasus (case approach). dan disajikan dalam bentuk diskriptif analitik dengan menggambarkan hasil dari penelitian ini secara jelas sesuai dengan pendekatan yang dilakukan. Penelitian ini diharapkan dapat memecahkan kebuntuan dan kevacuman serta permasalahan atas kewenangan pemerintah daerah dalam pengelolaan sumberdaya perikanan berdasarkan kewenangan pemerintah provinsi Kalimantan utara, dengan rumusan masalah diantaranya tentang bagaimana implementasi kewenangan pemerintah provinsi Kalimantan utara dalam pengelolaan sumberdaya perikanan serta upaya pemerintah meminimalisir konflik pengelolaan sumberdaya perikanan. Dari hasil penelitian dapat disimpulkan bahwa konsep yang dilakukan masih bersifat sederhana dan cenderung berorientasi pada upaya memperoleh Pendapatan Asli Daerah (PAD) sehingga upaya percepatan untuk mensejahterahkan nelayan belum maksimal sebagaimana diharapkan. Terhadap kewenangan dalam pengelolaan sumberdaya perikanan pada pelaksanaannya tidak terjadi pelanggaran kewenangan akan tetapi pemerintah provinsi Kalimantan utara belum maksimal dalam memanfaatkan kewenangan yang telah diberikan untuk mensejahterahkan masyarakatnya, sedangkan terkait upaya meminimalisir konflik pengelolaan sumberdaya perikanan, pemerintah provinsi Kalimantan utara telah melakukan beberapa upaya akan tetapi upaya yang dilakukan lebih pada upaya meredam dan bersifat sementara tidak menyelesaikan permasalahan dan cenderung menimbulkan masalah diantaranya tumpang tindih daerah penangkapan ikan, kepastian hukum dan keadilan serta perlindungan bagi nelayan kecil/tradisional.Kata Kunci: Kepastian hukum, Batas Wilayah Pengelolaan, Keadilan dan Penyelesaian KonflikABSTRACTThe authority to manage fisheries resources carried out by the regional government is in accordance with the division of functions authorized by the regional government of the province of North Kalimantan and has been carried out since regional autonomy began in the region. Until now, the concept of fisheries resource management carried out by the northern Kalimantan government is still simple and tends to be oriented towards efforts to obtain Local Revenue (PAD) so that the acceleration of efforts to prosper fishermen has not been maximized as expected. Regarding the authority in the management of fisheries resources in its implementation, there is no violation of authority, but the North Kalimantan provincial government has not been maximized in utilizing the authority that has been given to the welfare of its people. In an effort to minimize conflict over fisheries resource management, the North Kalimantan provincial government has made several efforts but the efforts made are more on efforts to reduce and temporarily not solve problems and tend to cause problems including overlapping fishing areas, legal certainty and justice and protection for small fishermen /traditional.Keywords: conflict, fisheries resourc

Realization of Regional Government budget (APBD) is one of measure instrument to see  the implementation from policies and operationalization implementation of financial regional management for optimal actualization public services. Management potential of Local Revenue (PAD) have to do with correct and appropriate in order to support the progress. The purpose of this research are to know and analyze the realization performance of regional government budget and district own source revenue potential at North Minahasa Region. The result of this research show the regional government budget of North Minahasa in terms of revenue considered good by looking from variance analyzes and tax effectiveness, expect from decentralization  degree analyzes is not good enough or low. While for expense, from variance analyzes over all is good by looking at the budget are well controlled and the impact in the North Minahasa Region for having an surplus from the allocated budget, and for compatibility analyzes expenditure are effective because realization of the expense budget not over amount that has been planned. And for the Own Source Revenue Potential for 2016-2020 seen from tax regional income are 42,78% while from regional retribution are 37,36%. Tulisan ini akan mengkaji tentang pengawasan  auditor Inspektorat Daerah terhadap efektifitas pelaksanaan tugas dan fungsi aparatur pada Perangkat Daerah Pemerintah Provinsi Sulawesi Utara. Penelitian ini dilakukan di Inspektorat Daerah Provinsi Sulawesi Utara. Inti dari tulisan ini bertujuan untuk mengetahui bagaimana pengawasan  auditor Inspektorat Daerah terhadap efektifitas pelaksanaan tugas dan fungsi aparatur pada Perangkat Daerah Pemerintah Provinsi Sulawesi Utara. Teknik dan prosedur pengumpulan data melalui wawancara mendalam kepada sejumlah informan berkaitan dengan pengawasan  auditor terhadap efektifitas pelaksanaan tugas dan fungsi aparatur. Informan penelitian yaitu Auditor dan pengawas penyelenggaraan pemerintahan daerah (P2UPD) pada Inspektorat Daerah Provinsi Sulawesi Utara. Hasil penelitian ini menunjukkan bahwa pengawasan  auditor inspektorat daerah terhadap efektifitas pelaksanaan tugas dan fungsi aparatur pada perangkat daerah Pemerintah Provinsi Sulawesi Utara sudah cukup maksimal. Inspektorat Daerah Provinsi Sulawesi Utara sudah mampu mendeteksi kelemahan-kelemahan pelaksanaan tugas dan fungsi aparatur pada perangkat daerah secara dini, sehingga perangkat daerah dapat memperbaiki kelemahan-kelemahan tersebut berdasarkan saran-saran dari Inspektorat Daerah. This paper will examine the supervision of Regional Inspectorate auditors on the effectiveness of the implementation of the duties and functions of apparatus in the Regional Apparatus of the North Sulawesi Provincial Government. This research was conducted at the Regional Inspectorate of North Sulawesi Province. The core of this paper aims to find out how the supervision of the Regional Inspectorate auditors will be effective in carrying out the duties and functions of the apparatus in the Regional Apparatus of the North Sulawesi Provincial Government. The techniques and procedures for collecting data through in-depth interviews with a number of informants related to the auditor's supervision of the effectiveness of the implementation of the duties and functions of the apparatus. The research informants were the Auditor and supervisor of regional government implementation (P2UPD) at the Regional Inspectorate of North Sulawesi Province. The results of this study indicate that the supervision of the regional inspectorate auditor on the effectiveness of the implementation of the duties and functions of the apparatus in the regional apparatus of the North Sulawesi Provincial Government is quite maximal. The North Sulawesi Provincial Inspectorate has been able to detect weaknesses in the implementation of tasks and functions of the apparatus in the regional apparatus at an early stage, so that regional authorities can correct these weaknesses based on suggestions from the Regional Inspectorate.

This article aimed to analyze and identify the strategies of Central Kalimantan Provincial Government as an effort to increase Regional revenue (Pendapatan Asli Daerah - PAD) through third-party grants or donations. One of the efforts made by the Central Kalimantan Provincial Government in increasing regional revenue (PAD) is through the issuance of Governor Regulation No. 16/2018 on Guidelines for the Acceptance and Management of Grants or Donations from Third Parties to the Central Kalimantan Provincial Government. The data showed that the governor’s regulation had shown positive results relating to the efforts to increase the Regional revenue in Central Kalimantan Province. Local Revenue Offices of Central Kalimantan as the leading sector to implement the regulation has made several strategic efforts including sharing/spreading the information to 3 P i.e., investors, monitoring and controlling. The purposes of the governor’s regulation No. 16/2018 to provide legal protection to guarantee the participation of third parties in Central Kalimantan development, provide legal certainty in the management and acceptance of third-party grants or donations, and create an orderly administration, transparency and accountability in acceptance the grants or third-party donations to the government of Central Kalimantan Province. The collaboration cooperation between Central Kalimantan Provincial Government and the private sector to increase Regional revenue (PAD) needs to have support from all parties.

Coastal reclamation has been increasingly growing in Indonesia is done by multiplying natural resources and economy in coastal management for the welfare of the surrounding community. The research objective is to determine the potential of coastal reclamation land in Coastal residents that is sustainable and to reconstruct a just marine environment reclamation policy. This research can be broadly grouped into the realm of the socio-legal approach. The results of the research showed that the potential for marine reclamation on the north coast of Jawa for business development and tourism areas for the welfare of the surrounding community. Since 2014, the authority of the sea and the coast has become the authority of the provincial government. The authority and supervision of the regional government are reduced, considered detrimental for the life of the coastal community which is the majority of fishermen. Hence, the policy reconstruction of marine environment reclamation is carried out by reconstructing the value of policies in the form of making policies that genuinely involve community and reconstructing the laws and regulations that are still in force.

This research was aimed to know the financial performance of the Central Tapanuli regency government in 2016-2018. This research is quantitative descriptive. The research used secondary data in form of Financial Report of Central Tapanuli regency in 2016-2018. The analysis technique in this study calculates and analyzes the ratio of the decentralization level, regional financial dependence and effectiveness. The results of this study indicate that the financial performance of the Central Tapanuli Tengah Regional Government is generally said to be quite good, although the degree ratio is still relatively low, financial dependence on the Central / Provincial Government is still very high and the receipt of Regional Original Revenue does not reach the budgeted target. Central Tapanuli Regency Government to update the data of regional taxpayers, explore the potential of new sources of local revenue, and increase the socialization of tax benefits and user fees.

Encoding is one of the mandatory matters that is not related to basic services. To elaborate regional authority related to coding matters, mapping of coding affairs is carried out in the context of structuring the Provincial / Regency / City Regional Institutional Apparatus in the Field of Encoding according to the direction of Law No. 23 of 2014 concerning Regional Government. With the enactment of Law Number 23 Year 2014 in the Jambi Provincial Government, especially in the Bungo District, realizing harmonization of policies between the center and the regions that synergize with each other and will achieve the goals of Regional Autonomy in the welfare of people's lives. In the Bungo Regency in the coding activity supported by 17 sub-districts within the Regency area, the implementation was not yet optimal. This research uses qualitative research methods, qualitative research has a flexible nature. This research found that the implementation of the duties and functions of the Bungo Regency coding team in maintaining confidential government information in the context of efforts to realize the integrity of the Unitary State of the Republic of Indonesia (NKRI) had not gone well. This is evidenced by the lack of awareness and responsibility of the coding team on the duties and functions of the coding field. Obstacles or obstacles facedby the coding team in carrying out their functions in safeguarding confidential government information in an effort to realize the integrity of the Unitary State of the Republic of Indonesia, including lack of awareness and full support from superiors or officials authorized to carry out coding functions and functions, there is no means from the government in the implementation of duties and functions in the coding field.

The region has the authority to manage and regulate its territory independently based on the mandate of Article 18 paragraph (2) of the 1945 Constitution. One such authority is to manage natural resources in this case conducting coal mining. The management of coal mining under the Minerba Act places the district/city government in authority in its management. Meanwhile, the Local Government Law places the provincial government also in possession of this management authority. This gave birth to the dualism of regulation in terms of the authority to manage coal, giving rise to a contradiction between one rule and another. The problem in this study is First, how is the condition of coal mining management by local governments in the perspective of regional autonomy? Second, what are the implications of the current coal mining arrangements by the regional government? The results of the study showed that coal mining authority from the district/municipal government under the Minerba Act then was transferred to the provincial government based on the Regional Government Law was reasonable because of various problems that arose from the authority of the district/city government. However, this fact puts the authority of coal mining management in dualism and disharmony in its regulation. This dualism has implications for the disruption of the pattern of authority relations between the central and regional governments, financial management between the central and regional governments, and the division of supervisory authorities between the central and regional governments.

Sumberdaya alam memiliki peranan penting bagi negara Indonesia sehingga dalam pengelolaannya diamanatkan pada Pasal 33 UUD 1945. Setiap sumberdaya alam memiliki ketergantungan baik bersifat langsung maupun tidak langsung. Sifat saling ketergantungan sumberdaya merupakan dasar utama yang menjadikan pengelolaan sumberdaya alam yang berkelanjutan menjadi penting untuk dilakukan. Pengelolaan sumberdaya perikanan di Indonesia diantaranya telah diatur dalam Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan sebagaimana telah diubah oleh Undang-Undang Nomor 45 Tahun 2009. Namun sejak tahun 2014 telah terbit Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintah Daerah, dimana didalamnya juga terdapat pengaturan tentang perikanan. Ketika pengelolaan sumberdaya alam diatur dalam berbagai undang-undang dapat menimbulkan saling tidak konsisten, bahkan saling tumpang tindih dan bertentangan dengan segala implikasi didalamnya. Tujuan dari penelitian ini adalah untuk memberikan gambaran terkait pengaturan sumberdaya perikanan di Indonesia yang tercantum dalam Undang-Undang No 31 Tahun 2004 tentang Perikanan sebagaimana telah diubah oleh Undang-Undang Nomor 45 Tahun 2009 dan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintah Daerah.  Hasil analisis menunjukkan bahwa terdapat perbedaan antara kedua undang-undang tersebut terkait wewenang pengelolaan wilayah penangkapan dan wewenang penerbitan izin pengadaan kapal penangkap dan pengangkut ikan. Adanya perbedaan ini dapat membuat undang-undang maupun peraturan yang telah diterbitkan menjadi tidak efektif dalam implementasinya. Oleh karena itu, turunan dari setiap undang-undang dan peraturan harus segera disusun agar pelaksanaan aturan dapat berjalan efektif tanpa tumpang tindih maupun saling bertentangan.Title: Fisheries Resource Management In Construction Regulations In Indonesia  Natural resources have an important role for Indonesia so that the management mandated by Article 33 of the 1945 Constitution Every natural resource dependent directly or indirectly. The interdependence of natural resources is a main reason for the sustainable management of natural resources is necessary. Fisheries resource management in Indonesia which have been regulated in Law Number 31 of 2004 on Fisheries as amended by Act Nomor 45 in 2009. However, since 2014 has published Law Nomor 23 Year 2014 on Regional Government, where it will also include regulations on fisheries. When the management of natural resources regulated in various laws can be inconsistent, even overlap and conflict with all the implications therein. The purpose of this study is to provide an arrangement related to fisheries resources in Indonesia listed in Act Nomor 31 of 2004 on Fisheries as amended by Act Nomor 45 of 2009 and Act Nomor 23 of 2014 on Regional Government. The analysis showed that there were differences between the two laws related to fishing area management authority and the authority issuing permits procurement of fishing vessels and fish transport. The existence of these differences can make laws and regulations that have been issued to ineffective implementation. Therefore, a derivative of any laws and regulations must be drafted for the implementation of the rules can be run effectively without overlapping or conflicting.

The position of the customary rights of the customary law community in the Toba Batak community, namely the rights owned by a clan (State land), controlled, managed, utilized, the land and its contents for the needs of the citizens / descendants of the partnership as collective property that can be passed down from generation to generation (geneological) based on customary law. The UUPA recognizes the position of the ulayat rights of the customary law community in a formal juridical manner with discussion if in reality it still exists and does not conflict with the interests of the national, nation and state. The 1945 Constitution of the Republic of Indonesia Article 18-B paragraph (2), Article 28-I paragraph (3) The State recognizes and respects the customary public and their traditional rights as long as they are still alive. The cultural identity of traditional community rights is respected in accordance with the times and civilizations. The position of the customary rights of the Batak Toba community (land marga) in this study is still not as expected, in regulating and protecting laws from the past to the present, regulation and protection are still based on local customary laws. In Law No. 23/2014/9/2015 concerning Regional Government grants the authority of rights and responsibilities to provincial, regency / city governments to regulate and manage their own regions, one of the areas of defense based on the widest possible regional autonomy. The authority, rights and responsibilities of regional governments in regulating and protecting, managing their own ulayat rights (clan land) in certain areas are also in line with Presidential Decree No. 34 regarding policies in the defense sector, one of which is stipulation and is also in line with the government regulation of the Republic of Indonesia No. 38 Year 20007 concerning the Division of Government Affairs between the government and the Provincial Government of the Regency / City Government as a government affair which becomes the authority of the regional government towards the position of the ulayat rights of the customary law community in certain areas. In this study, in the Daily District of Samosir Regency. The authority, rights and obligations of Regional Government through stipulation in the form of Regional regulations have not been implemented, especially regarding local clan lands (ulayat rights of indigenous peoples). Therefore, this problem needs to be researched to get a true picture of the status of customary community rights in relation to regional autonomy in the Daily District of Samosir Regency. The results of this study, in the Samosir Kewenagan Regency Daily sub-district, the rights and obligations of regional government, it turns out that Tanah Marga (Hak Ulayat) is still regulated by local customary law, in fact the local government has the authority, rights and obligations to regulate and protect Ulayat Rights (Tanah Marga). certain by stipulation in the form of regional regulations, with the aim of providing legal certainty and benefits for the customary law community. Based on the research, it shows that the Land of Marga / Ulayat Rights of Indigenous Peoples in Harian District, generally in Samosir Regency, both horizontally and vertically until this research was conducted, there has been no settlement of certain customary rights of customary communities, in other words conflict resolution is still stagnant. The government needs to immediately establish the customary rights of customary communities in the form of a law. To ensure legal certainty / benefit and justice for all certain Customary law communities. Because ulayat rights are basically still found and still live according to the civilization of the Batak Toba people in the Daily District of Samosir Regency, which does not conflict with the development and interests of the Nation and the State.

Untuk itu daerah otonom diberikan kewenangan untuk membentuk peraturan daerah. Penelitian ini merupakan penelitian hukum normatif yang membahas tentang urgensi pembentukan peraturan daerah pada era otonomi daerah ialah sebagai rule dari pelaksanaan otonomi daerah, utamanya menyangkut urusan-urusan pemerintahan sebagaimana dimaksud pada Undang-Undang Pemerintahan Daerah dan Peraturan Pemerintah Nomor 38 Tahun Tahun 2007 tentang Pembagian Urusan Pemerintahan antara Pemerintah, Pemerintahan daerah Provinsi, dan Pemerintahan Daerah Kabupaten/Kota. Serta konsep ideal peraturan daerah pada era otonomi daerah dikembalikan kepada asas formil dan materil pembentukan peraturan perundang-undangan sebagaimana termuat didalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan. URGENCE FOR ESTABLISHING REGIONAL REGULATIONS IN THE ERA REGIONAL AUTONOMY The implementation of decentralization in a unitary state means giving the right to regulate and manage the interests and aspirations of the local community, the formation of an autonomous region and the delegation of legal authority from the central government to the regional government to regulate, manage and/or part of certain government affairs. For this reason, autonomous regions are given the authority to form regional regulations. This research is a normative legal research that discusses the urgency of the formation of regional regulations in the era of regional autonomy, namely as a rule for the implementation of regional autonomy, especially regarding government affairs as referred to in the Regional Government Law and Government Regulation Number 38 of 2007 concerning Division of Affairs. Government between the Government, Provincial Government, and Regency/City Regional Government. And the ideal concept of regional regulations in the era of regional autonomy was returned to the formal and material principles of the formation of laws and regulations as contained in Law Number 12 of 2011 concerning the Establishment of Legislations.
