The paper presents Jürgen Habermas' epistemological views on the theory of deliberative democracy. Habermas has been constructing a series of assumptions since the 1970ies about his Theory of Communicative Action to overcome the crisis of legitimacy. This position stems from the critique of the deep chasm that exists between the "constitutional-democratic legal order" as a normative framework and how forms of social power are imposed to undermine the legitimate process of passing laws. The course of Habermas's argumentation theorizing about communicative action and the communicatively based process of (democratic) political decision-making brings with it the potential to break with the procedural argumentation of the representatives of the so-called aggregate models of democratic practice. For the development of the theory of deliberative democracy, its sociological sharpness may be important, with the help of which the social basis of legal projects and public policies leads to the clarification of the external tension that exists between facticity and validity. Thus, Habermas respects the differences between facts and norms in every contemporary concept of law. This can be called the legal theory of deliberative democracy that has shaped the modern understanding of the conception and practice of deliberative democracy.

This article aims to analyze inter-religious relationships based on the local wisdom of Gandong in Maluku, especially in the Nusalaut and Ambalau society as a strength in the modern era. It focuses on the social activities from the two communities as religious development in Maluku. The values of social activities become an inter-religious spirituality that is still passed down from generation to generation. Inter-religious relationships based on local wisdom (Gandong) from Nusalaut-Ambalau were analyzed using the communicative action theory approach by Jurgen Habermas. This article used a qualitative research method through interview technique, observation, and library study. Communicative actions have become an effort to maintain interreligious relationships in folklore. The growing folklore's imagination can be used by society as a preventive imagination on destructive realities.AbstrakTulisan ini bertujuan menganalisis hubungan antaragama yang berbasis pada kearifan lokal Gandong di Maluku, khusus pada masyarakat Nusalaut dan Ambalau sebagai sebuah kekuatan di era modern. Fokus pada aktivitas sosial berupa tindakan dari kedua masyarakat tersebut sebagai pengembangan beragama di Maluku. Nilai-nilai dari aktivitas sosial menjadi sebuah spiritualitas antaragama yang masih diwarisi turun-temurun dari generasi ke generasi berikut. Relasi antaragama yang berbasis pada kearifan lokal (Gandong) dari Nusalaut-Ambalau dianalisis menggunakan pendekatan teori tindakan komunikatif Jurgen Habermas. Penelitian ini menggunakan penelitian kualitatif – deskriptif dengan teknik wawancara dan studi pustaka. Tindakan komunikatif menjadi upaya menjaga relasi antaragama dalam folklor. Imajinasi folklor yang berkembang dapat dijadikan oleh masyarakat sebagai imajinasi preventif pada realitas destruktif.

O artigo tem por objetivo verificar a viabilidade e aplicabilidade do conceito teológico de recepção na realidade concreta da vida social e eclesial, ou seja, no mundo da vida da Igreja. O texto faz uma releitura do conceito, ampliando-o e trazendo-o para o campo das Ciências Sociais, por meio da proposta teórica de Jürgen Habermas na Teoria da Ação Comunicativa. Para isso, verificaremos tal processo de recepção nas Igrejas locais do Estado do Maranhão.ABSTRACT: The purpose of the present article is to verify the viability and applicability of the theological concept of reception in the reality of the social and eclesial life, in other words, in the lifeworld of the Church. The text revisits the concept, extending it and applying it to the field of Social Sciences, through the theoretical proposal of Jürgen Habermas in his Theory of Communicative Action. We will thus verify the process of reception in the local Churches of the State of Maranhão (Brazil).

Resumo: O presente trabalho pretende estabelecer uma analogia entre as teorias democráticas deliberativas de John Rawls e Jürgen Habermas, por meio de uma análise comparativa. As concepções formuladas pelos dois expoentes teóricos sobre o tema buscam equacionar o pluralismo político com diferentes justificativas. O tema foi eleito em razão da importância de discussão das fontes de legitimação dos Estados democráticos. Enquanto Rawls propõe uma democracia substantiva, Habermas defende a procedimental. O objetivo é traçar, em linhas gerais, as teorias de ambos, sem exposição de juízo de valor entre elas, e destacar seus pontos de convergência e os antagônicos. O método utilizado foi a pesquisa bibliográfica dedutiva, tendo como base algumas das principais obras dos autores, além de obras e artigos de seus comentadores O artigo aborda, em primeiro lugar, a Teoria da Justiça como Equidade, de Rawls, com a retomada da teoria contratualista com peculiaridades; a posição original e o véu da ignorância; o consenso sobreposto e a razão pública e os princípios da justiça. Em um segundo momento, é exposta a democracia procedimental de Habermas, o agir comunicativo e a esfera pública, a equiprimordialidade entre autonomia pública e privada e a Teoria Discursiva do Direito. Por fim, salientam-se os principais pontos de convergência, bem como as divergências, enfatizando-se a importância da democracia deliberativa nos países democráticos.Palavras-chaves: Democracia Deliberativa. Esfera Pública. Abstract: This works aim to establish an analogy between Deliberative Democratic Theory from John Rawls and Jürgen Habermas through a comparative analysis. The conceptions developed by these two exponents theoreticians seek to give some thoughts to political pluralism using different justifications. This theme was chosen in order to feed into the discussion on the importance of the legitimacy of the Democratic State. John Rawl’s theory sets out substantive democracy, whereas Habermas proposes the procedural one. This paper attempts to outline both theories, without making value judgments, however it intends to highlight points of convergence and divergence. The method used was the deductive bibliographic research relaying on major works from these two authors and on writings an articles from their commentators. In an attempt to shed some light on the debate, primarily this paper discusses Rawl’s Theory os Justice as Equity from the point of view of Contractual Theory and its specials characteristics, the original position and the veil of ignorance, public reason and principles of justice. In a second moment, it presents Habermas Procedural Theory, communicative action, public sphere, equiprimordiality between public and private autonomy and Law Discursive Theory. Lastly, this works draws attention to the main points of agreement as well as disagreements emphasizing the importance of the deliberative democracy in democratic countries.Keywords: Deliberative Democracy. El objetivo de este artículo es defender que la pragmática transcendental ofrece la fundamentación normativa de la teoría crítica como teoría de la acción comunicativa. Para ello se expondrá en primer lugar el problema de la normatividad en la Teoría Crítica de la sociedad. Tras describir la forma que adquiere esta teoría tras el giro lingüístico operado por Jürgen Habermas, se reconstruirán en tercer lugar los elementos fundamentales de la pragmática transcendental apeliana y habermasiana. En cuarto y último lugar se mostrará que este modelo constituye la fundamentación normativa de la nueva teoría crítica. The aim of this paper is to argue that transcendental pragmatics constitutes the normative foundation of critical theory, understood as theory of communicative action. To that end, the issue of normativity within Critical Theory discussions is first exposed. After describing the form this theory takes from the linguistic turn carried out by Jürgen Habermas, key elements of Karl Otto Apel´s and Jürgen Habermas´ transcendental pragmatics are thirdly reconstructed. Fourth paragraph shows that this model operates as the normative foundation of the new critical theory.

Discussions of the relationship between justice and democracy are generally premised on the assumption that they are two different things, only contingently and externally related. As a result, genuine conflicts seem possible whereby we are forced to decide whether democracy should trump justice or whether justice has priority over democracy. By focusing on the work of Jürgen Habermas and Rainer Forst, this chapter aims to show that deliberative democracy can provide a constructivist conception of justice which challenges this premise by explaining the internal relationship between justice and democracy. There is no justice without democracy in the sense that only citizens can democratically determine the specific content of justice. At the same time, there is also no democracy without justice in the sense that democratic outcomes are legitimate only to the extent that they can be understood as proper elaborations of the substantive but abstract ideal of justice-as-impartiality.

Resumen:El pragmatismo y la sociología son, por decirlo así, primos hermanos ya que fueron engendrados en la segunda mitad del siglo XIX por la modernidad y la imperiosa necesidad de contrastar procesos sociales y económicos mediante una postura científica, crítica y participativa. Sin embargo este lazo de parentesco no significa que en la actualidad se haya dado una relación real a través de la constitución por ejemplo de un programa sociológico de corte pragmatista. La tradición pragmatista no es sino una fuente entre muchas otras para el pensamiento de autores tan diversos como son Jürgen Habermas y David Bloor. Lo único que encontramos cuando se revisan las fuentes son contados casos de acercamiento teórico entre ambas miradas y formas de acción, esto es, mediante textos de Emilio Durkheim (1913-1914), Charles W. Mills (1968) y hoy día con Hans Joas (1998 y 2002). En este artículo se pretende discutir sobre los posibles aportes del pensamiento pragmatista para la reflexión sociológica, los cuales giran en torno a buscar soluciones a problemas metodológicos-teóricos. En este sentido la concepción “práctica” de la realidad social como un proceso continuo y situado en un espacio “plástico” o, conforme a G.H. Mead y John Dewey, el re-planteamiento del concepto de acción social como “acción creadora culturalmente situada” pueden ser de gran interés para ampliar las perspectivas de la reflexión sociológica.Palabras clave: Sociología, Pragmatismo, Acción Creadora, Creencia y Continuidades.AbstractPragmatism and sociology are sort of first-cousins as both emerged from modernity in the second half of the nineteenth century, upon the need to contrast social processes with economic ones from a scientific, critical and participative approach. However, this does not mean there is currently a real link between the two of them given by, for instance, the development of a sociological programme based on pragmatism. The pragmatic tradition is only one of the many other sources for various thinkers like Jürgen Habermas and David Bloor. The only theoretical link and ways of action connecting these two disciplines are given in cases such as Emilio Durkheim (1913-1914), Charles W. Mills (1968) and nowadays Hans Joas (1998 and 2002).  This article aims at discussing about the potential contributions of the pragmatic thought to the sociological one in order to find answers to methodological and theoretical problems. In this sense, the "practical" conception of the social reality as a continuous process placed in a "plastic" space, as stated by G.H Mead and John Dewey, reshaping the social action concept as a "creative action culturally placed" may be of help to expand sociological perspectives.Key words: sociology; pragmatism; creative action; belief and continuities
