The article analyzes the nature, content, and variety of procedures that are used by authorized subjects (organizations and government agencies) for the purposes of financial monitoring as a form of financial control of banking operations in the Russian Federation. The author proposes a classification of financial monitoring procedures based on analysis of the national banking legislation and secondary legal acts issued by the Central Bank of the Russian Federation. A definition of the notion of legal techniques used for financial monitoring of the banking system in Russia is also presented. The paper argues in favor of comprehensive financial monitoring, as well as combined control and informational nature of procedures used for the financial monitoring of banking operations in Russia.

The article deals with the actual problem of integrating cryptocurrency into the banking system of the Russian Federation. The authors propose a definition of cryptocurrency, substantiate the demand for the use of digital currency in the economy. The article considers the specifics of modern legal regulation of cryptocurrency transactions and the prospects for its development in the Russian economy.

The article analyzes damage caused by attacking finance organizations in the Russian Federation through activization of hacker groups. The mentioned attacks were mainly directed at banking cards’ processing, cash machines and the SWIFT system, an international system of transmitting finance information and payments. The growth in hacker penetrations can be seen in all sectors of Russian economy, it is based on informational confrontation and aims at destabilization of considerable objects of critical information infrastructure. Today special attention is paid to attacks of hacker groups, which get financing from states and criminal groupings in order to exert influence on the leading banks of the world. The author investigated the key methods of attacks of finance organizations. The role of the Federal service on technical and export control and the Department of information security of the Bank of Russia was described. By assessing the impact of computer attacks the author came to the conclusion that the Russian banking sector is vulnerable to computer attacks on informational systems that could cause damage not only to small but also big credit organizations, which possess over 60% of the Russian banking sector assets.

Changes of them political situation in the world, introduction of economic sanctions in regard to the Russian Federation have changed the situation in banking system and have had an impact on the banks activities with foreign participation. The article examines possible variants of foreign capital in the banking system of the Russian Federation, presents the foreign and national practice of the Bank of Russias regulation of foreign investments into the banking sector beginning from 1991 till present. It shows the foreign capital role in own funds (capital), in assets of the Russian Federation banking sphere, in attracting monetary funds of private and legal entities in crediting the real economic sector. It notes that against the general background of decreasing number of the credit organizations of the Russian Federation there is a decrease of the number of the banks with foreign participation, their structural subdivisions. Beginning from 2013, there is a decrease of the foreign capital share. The aggregate charter capital of the national banking system manifests negative trends and other indicators of the banks activities with foreign participation. Beginning from 2014 and up till now, the role of the banks with foreign participation in the banking sector of the Russian Federation is beginning to go down.

The article provides a new classification of evaluative concepts enshrined in the Criminal Code of the Russian Federation, indicates the purpose of its existence in the doctrine of criminal law. The article describes the definition of constitutive evaluative concepts that are determined as legislatively vague evaluative concepts that, by their normative-essential and functionally-substantive characteristics, are absolute, necessarily alternative, or accompanying structural features of a crime. Through the prism of the features of constitutive evaluative concepts, their varieties, essential features and functions are distinguished; interpretation (including cognitive) meaning is revealed. Moreover, the interpretation features of these evaluative concepts are considered in two interdependent aspects: the structurally-essential (associated with the types, attributes and functions of constitutive evaluative concepts) and the procedural-substantive (associated with the informative and informative activities of the interpreter). It is indicated that the interpretation features of an structurally-essential nature are, firstly, in the composition and criminogenic properties of constitutive evaluative concepts, and secondly, in the semantic structural composition, indicating a meaningful dependence of the evaluative concept on the accompanying structural features of a crime, and thirdly, legally significant functional features. At the same time, interpretative features of a procedural-substantive order are also highlighted, which include, firstly, the need for a paramount definition of the criminogenic determinant, designed to establish the structural features of a crime in a perfect act, and secondly, in an increased degree of normative casuistic derivative of these evaluative concepts. The author comes to the conclusion that constitutive evaluative concepts are interpreted according to the same logical-linguistic and legal laws, but with some marked structurally meaningful features.

В статье рассматриваются основания смягчения уголовного наказания в уголовном законодательстве Российской Федерации. Основания смягчения уголовного наказания направлены на снижение бремени уголовного наказания, что в свою очередь опосредованно влияет на процесс реализации уголовной политики. Проводится различие терминов «смягчение» и «освобождение» от уголовной ответственности и ее «исключение». Исследуются межотраслевое содержание системы оснований смягчения уголовного наказания, а также признаки системы оснований смягчения уголовного наказания и классификация оснований смягчения уголовного наказания. Дается доктринальное определение системы оснований смягчения уголовного наказания. The article discusses the grounds for mitigating criminal punishment in the criminal legislation of the Russian Federation. The grounds for mitigation of criminal punishment are aimed at reducing the burden of criminal punishment, and that, in turn, indirectly affects the process of implementation of criminal policy. A distinction is made between the terms “mitigation” and “exemption” from criminal responsibility and its “exclusion”. The intersectoral content of the system of grounds for mitigation of criminal punishment, as well as signs of the system of bases for mitigation of criminal punishment and the classification of the grounds for mitigation of criminal punishment are investigated. A doctrinal definition of the basis for the mitigation of criminal punishment is given.

This article is devoted to the study of social responsibility of commercial banks. The author discusses the main challenges, mechanisms and trends in the development of social responsibility of the banking sector. Results of the research allow to conclude that the principles of social responsibility is currently not fully implemented in the strategy of development of domestic commercial banks, and the level of social responsibility of commercial banks is still quite low, as the level of trust of Russians to banks. The article examines some essential aspects of the development and formation of the social responsibility of commercial banks in the Russian Federation.

Introduction. Financial technology or fintech is one of the most discussed problems of the modern digitalization. Particular attention is paid to describing what the fintech industry is, how it relates to traditional financial regulation and to what extent the official recognition of financial technologies can affect economic regulation and the global economy. Theoretical Basis. Methods. The article examines the concept of fintech and the regulatory as- pects of the so-called “sandbox”, which allows, being based on the comparative legal method and the method of legal expertise, to extrapolate specific problems to the entire situation in the field of fintech regulation. The author offers an overview of the main stages of the formation of legislation on financial technologies and examines the role of the Bank of Russia in this process. Results. Arguing about the consequences of such a concentration of regulatory mechanisms in the banking sector, the author thinks about the actual leveling of digitalization of banks with banking financial technologies in the science and practice of the Russian Federation. Based on a brief review of academic approaches to the definition of financial technologies, the author draws a number of parallels that allow one to outline the reasons for judicial errors and the reasons for excluding changes in fintech legislation from the attention of domestic courts, and draws conclu- sions about the general and particular consequences of the current situation. Discussion and Conclusion. During the study, the author comes to the conclusion that the scien- tific opinion about the development of the fintech industry and the need for its regulation in the Russian Federation is based on a narrow understanding of fintech itself and the peculiarities of introducing financial technologies into the practice of services. The author believes that the par- adigm for the development of the domestic fintech market is focused on the so-called banking fintech, when financial technologies are consumed and built into the ecosystem of specific banks’ activities and are not provided by non-banking entities. This leads to the fact that legislative regu- lation focuses on the development of banking law and, at the same time, excludes from the atten- tion of the legislator and the main regulator – the Central Bank of the Russian Federation – other areas, such as, for example, insurance or non-banking investment. This situation makes it pos- sible to ask the question of how much the image of fintech, formed in domestic law, corresponds to its actual state and market development, and in what proportion is the process of digitalization of traditional banking services understood by fintech.

The paper analyzes the banking systems of the Slovak Republic under the influence of the European Union legislation and banking system of the Russian Federation from the perspective of opening the banking sector to foreign capital. A fundamental difference between the given legislations, which is reflected mainly in the recent period, lies in the degree of openness of the banking system to foreign capital. While the banking system of the Slovak Republic under the influence of the European Union law can be considered as highly open banking system to foreign capital, the legislation concerning the Russian banking system is characteristic by legal limitation for foreign capital entry. The analysis of these contradictory tendencies which have common goal – to ensure a stable banking system could bring important knowledge that may help in resolving the issue of stability of the banking system at the global level.

The financial system of the Russian Federation is currently facing deterioration of the conditions of external business environment. The spread of the coronavirus infection COVID-19 turned 2020 into the most difficult year for development of banking system of the Russian Federation. This article is dedicated to the research analysis of practical role of securitization as a mechanism and method used in management of the internal liquidity of a commercial bank. The relevance of this study is substantiated by the need to improve the mechanisms of financial risk management, which emerge in activity of credit institutions that experience a shortfall of internal liquidity of the assets. Methodological framework is comprised of the general scientific methods of cognition of economic phenomena, which allowed viewing the relevant tools of managing the liquidity of commercial banks and indicating most topical issues and barriers. The research is based on the combination of normative and positive analysis, principles of uniformity of historical and logical, as well as analytical approach towards studying the economic phenomena that reflect the contradictory nature of social processes. The article examines the relevant problems of formation of the internal liquidity of banking sector of the Russian Federation; as well as theoretical aspects of the concept of “liquidity” of a commercial bank. Description Is given to the mechanism of managing the liquidity of a commercial bank. The author considers the fundamentals and characteristic of securitization as a method of managing liquidity of a bank, and lists the advantages of using securitization in ensuring internal liquidity of banking activity. The benefits of securitization as a method of managing the liquidity of commercial banks in the Russian Federation are analyzed.
