Political-Administrative Interface at the Local Sphere of Government with Particular Reference to South Africa

The ongoing political-administrative dichotomy discourse, which is steeped in public administration history, manifests in uncertainty about how the relationship between politicians and administrative officials should be structured. South Africa was democratized in 1994 and local government has subsequently undergone a fundamental socio-political transformation. “World class” local government legislation, with an entrenched constitutional development mandate, was introduced; however, the large numbers of public protests bear ample testimony to major challenges in basic service delivery. A critical issue impacting negatively on the functionality of the post-1994 local government dispensation is the political-administrative interface. The National Development Plan has mapped out a socio-economic vision to 2030, with stabilization of the political-administrative interface a priority. Consequently, the political-administrative interface has to be critically reviewed relative to the quality of local democracy, impact on efficient and effective service delivery, and good local governance.

South African political interference in the administration of service delivery is a serious problem in many municipalities, where municipalities are experiencing serious challenges in dealing with the interface between politicians and officials. Inappropriate political interference in administrative matters as well as strained relations between key political and administrative officials in the municipalities appear to be the order of the day. To understand the impact or consequences of political interference in the administration of service delivery, a case approach was adopted to evaluate the political interference in the administration of service delivery in uMlalazi Local Municipality of Kwazulu- Natal, South Africa. Participants comprises of Municipal Officials in the administrative side of the municipality, members of Ward Committee as well as other political parties expect the political party in power. The literature seeks to review the political-administrative interface, South African local government service delivery, conflation of legislative and executive roles of local government, reflection on local government performance and the critical issue of poor service delivery in South Africa.

In 2013 and 2019, the local government legislation of the province of Punjab in Pakistan saw two rounds of major changes – each of which led to a new local government Act being passed. In 2013 the changes were driven by constitutional and judicial requirements and in 2019 by the political will of Pakistan’s new coalition government. This article analyses and compares the functional assignment (FA) architecture of the two Acts against a set of parameters. The study finds that marginal improvements to the FA architecture introduced by the 2019 Act are offset by continuing inconsistencies and lack of clarity over ‘who does what’ in the functions assigned to local governments. The authors suggest that improving the functionality of local governments requires full implementation of the design features of the new system, including institutional strengthening of provincial-level entities which regulate and oversee the local government system.

Ghana‘s decentralization concept was initiated to promote popular grassroots participation in the management and administration of local governance institutions for improved conditions of life. This is believed to be an important means to improving the effectiveness of service delivery and empower the local people to participate in the development processes that affect their lives. Despite this important role of local communities and stakeholders in the local governance processes, their involvement in decision making on planning, budgeting and financial management of local government agencies is only marginal. This low level of participation is one of the most structural challenges confronting Ghana‘s decentralisation process and local government financial management. Using Stakeholder Analysis, this paper examines the role and level of participation of stakeholders in planning, budgeting and financial management of the Sefwi Wiawso Municipal Assembly. The results of the study indicate that, there has been very little space for local participation and that most of the stakeholders lack proper understanding of the planning, budgeting and the financial management systems of the district assemblies. This lack of space for stakeholder participation has constrained the promotion of effective, responsive and responsible government at the local level for poverty reduction. Procedures and structures for community engagement in the monitoring and evaluation of development interventions seldom exist. The paper argues that an effective engagement of local communities and other stakeholders will enhance transparency and improve upon service delivery within the local government systems. A conscious effort to build capacities and create space for local engagement will enhance the efforts of decentralisation and fast track poverty reduction and national development in Ghana

Negotiations to restructure and transform local government in South Africa commenced in 1993. Key roleplayers and stakeholders in local government were instrumental in adopting a negotiated local government model comprising three distinct phases during the constitutional development process. The Local Government Transition Act, 1993 (Act 209 of 1993) facilitated the process for the introduction of transitional local and metropolitan councils which constituted the first phase. Local government elections were held for the first time in November 1995 and May/June 1996 in seven provinces (and thereafter Western Cape and KwaZulu-Natal) constituted the second phase. Three fundamental legislative enactments, i.e. Local Government: Municipal Demarcation Act, 1998 (Act 27 of 1998); Local Government Municipal Structures Act, 1998 (Act 117 of 1998) and the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000), were critical to the final phase. Elections held in December 2000 marked the end of the transition period resulting in a reduction of municipalities from 843 to 283. There were two successful local government elections held thereafter on 26 March 2006 and more recently on 18 May 2011. Regular elections and the plethora of legislation introduced to consolidate the new dispensation have resulted in local democracy and decentralization being deeply rooted in the local governance system. The latter is an integral component of the local governance policy framework as the country has a diverse population of almost 50 million people. It is believed that a democratic and decentralised governance system will promote local development, address poverty reduction, facilitate civic engagement and ensure national integration. Local democracy, introduced seventeen years ago following the ushering in of the developmental state in 1994, has since been tried and tested. Despite ‘world class’ legislation and a ‘best practice’ local governance system, which has as its basis people centred development, engagement and decentralisation, several governance challenges has emerged. This includes inter alia, unfunded mandates; rampant corruption and nepotism;violent service delivery protests; capacity constraints; crime, lack of communication, transparency and accountability; limited civic engagement and a significant number of municipalities that are not financially viable. These issues will have to be addressed if Chapter 7 of the Constitution has to become more meaningful to the majority of the populace in terms of discharging its developmental mandate.

Local government in South Africa is no longer simply an extension of the national and provincial spheres of government; it has become an independent sphere in its own right. Steady progress has been made in the delivery of services since the advent of a democratic and developmental state in 1994. The 1996 South African Constitution positions local government as an independent sphere of the government, interrelated to and interdependent with the national and provincial governments. To give it a collective voice, local government speaks from a position of strength through organised local government, as embodied in the South African Local Government Association (hereafter referred to as SALGA). The government is aware of the challenges facing local government service delivery, particularly in the rural areas, where progress in service delivery has been slow. During the former Presidential Izimbizo’s, the gap between the government’s delivery efforts and communities’ ability to benefit from that delivery was repeatedly highlighted. The introduction of community development workers (CDWs) is to assist the three spheres of government to ensure that service delivery reaches the intended recipients effectively and efficiently (IDASA, 2006: On- Line).It was against this background that community development workers (CDWs) were introduced as a link between the government and communities. CDWs are defined as participatory change agents who work in the community in which the live, and to whom they have to answer for their activities. They are required to help members of the community to improve their living standards and change circumstances. To do this, CDWs are expected to make the poor aware of their constitutional rights such as their right to basic service delivery including social grants and assist community members to understand how they can participate in the development plans for their communities. CDWs are expected to facilitate community participation in policy-making, implementation and in service delivery (Republic of South Africa. Grassroots Innovation, 2007). In this article, the role of community development workers in enhancing service delivery within the Bitou Local Municipality is discussed. The debate on service delivery and governance takes a centre stage across disciplines, schools of thought, countries, and in all platforms where people are able to raise their views othe two subjects. According to scholars and analysts, service delivery and <br />governance are closely related, and in many forms of government, service delivery occurs at the lower sphere which is the sphere closer to communities. TheSouth African context can serve as an exact scenario of this model. This makes local government to be a very important subject on matters of service delivery. South Africa has an interesting history that makes scholars, analysts, commentaries, and media companies worldwide to always keep a close eye on what happens in the country. This becomes clear from the analysis which makes the country to be theorised as a colonisation of a special type. It therefore becomes inevitable to consider the antecedents that shaped the manner in which governance and service delivery were mapped out in South Africa. This paper serves as analysis of local government and service delivery both in apartheid and post-apartheid South Africa.

The post-1994 democratic developmental South African state opted for a strong local government system which has been constitutionalised, in terms of Chapter 7 of the Constitution of the Republic of South Africa Act 108 of 1996. The politicisation of the local bureaucracy was inevitable as the ruling party sought to ensure that the executive leadership of municipalities shared the same political ideology and vision to facilitate local development. This raises the question, where does politicisation commence and end, and what is the ideal local political interface for efficient and effective service delivery and, more importantly, to ensure good governance? These questions have to take cognisance of the fact that South Africa is a ‘struggle democracy’ and development has to take place in historically disadvantaged areas, where services have been poor or non-existent. The historically advantaged areas have to also be maintained and upgraded, as they are key to financial sustainability of the municipalities. The increasing service delivery protests is a matter for concern, if one has to take cognisance of the popular adage highlighted in official literature, ‘if local government fails, South Arica fails’. Given that the struggles for a democratic South Africa were fought at the grassroots level, this has to translate to an improved quality of life for local communities. Consequently, sound political management is key to enhanced municipal service delivery and ultimately good local governance. This paper reviews political trends and developments up to 2016, but excludes any discussion on the recent local government elections.

Devolution, which was incorporated into the Constitution of Zimbabwe through section 264, is a new phenomenon in Zimbabwe. This incorporation came about because of the need for participatory governance and the devolution of power away from the centre. Over the years, local governance has been informed by a plethora of pieces of legislation that do not provide an enabling environment for citizen participation, giving Zimbabwe’s local government a chequered history that excludes citizens from participating in public affairs that affect their lives. An analysis of section 264 of the Constitution revealed that devolution has the propensity to enhance transparency, efficiency and effectiveness as well as the fulfilment of central government’s responsibilities at provincial and local levels. This article argues that the belated implementation of the devolution of power has delayed improved service delivery, effectiveness, efficiency and accountability within local governance. This article further seeks to explain how the implementation of section 264 of the Constitution can bring about good local governance.
