The appearance of the Acts Number 11 the Year 2012 is a new hope for the victims in order to gain their rights. This Act has given a huge opportunity to the victim by means of the concept of restorative justice. For that reason, this work would offer the model of the involved victim which is able implemented by either outside or inside of the judicial system. Firstly, accessibility for the victim in this Act has placed the concept of restorative justice. The model of restorative justice which offered in this Act is the gate for the crime victim who fought for their rights. Restorative justice was essentially stood for in human relation between victim and offender and focused on the impact that caused by crime. Secondly, the term of Diversion is the transfer of resolution for the process of the juvenile case from the judicial system into outside of judicial criminal system. Togetherness for all of the involved groups is better solution in the certain case and togetherness solved problem and created such obligation that would produce better than before. This attempt is in order to seek a solution, reconciliation, and not to revenge for a criminal offence. Thirdly, the involved victim in process of the judicial criminal system is a victim witness. This witness also should possess legal protection and avoid the bad label. The next model is an opportunity for the juvenile victim who would affirm argumentation before the court handing down the verdict.

Penelitian ini bertujuan menganalisis dan memperoleh pemahaman terhadap penerapan nilai serta hambatan dalam penerapan keadilan restoratif pada perkara peradilan pidana anak sesuai dengan Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dalam rangka memberikan perlindungan hukum bagi Anak yang berkonflik dengan hukum dan kendala yang dihadapi majelis hakim pengadilan Negeri watansoppeng dalam menerapkan keadilan restoratif untuk mengadili tindak pidana yang dilakukan oleh anak. Hasil penelitian menunjukkan bahwa terkait proses persidangan terhadap kasus anak, hakim Pengadilan Negeri Watansoppeng senantiasa mengupayakan penerapan restoratif justice dengan memberi saran kepada korban, terdakwa dan pihak keluarga untuk mengusahakan perdamaian sebagai upaya penyelesaian kasus di luar jalur persidangan, namun upaya tersebut seringkali ditolak oleh korban dan keluarganya dan menginginkan agar pelaku dihukum seberat-beratnya. Faktor Kebudayaan dari keluarga korban inilah yang tidak mendukung penyelesaian perkara di luar peradilan atau perdamaian. This study aims to analyze and gain an understanding of the application of values ​​and obstacles in the application of restorative justice in juvenile criminal justice cases in accordance with Law Number 11 of 2012 concerning the Criminal Justice System for Children in order to provide legal protection for children who are in conflict with the law and the obstacles they face. watansoppeng District Court panel of judges in implementing restorative justice to adjudicate crimes committed by children. The results showed that in relation to the trial process for juvenile cases, the judges at the Watansoppeng District Court always tried to apply restorative justice by advising victims, defendants and their families to seek peace as an effort to resolve cases outside the court, but these efforts were often rejected by the victim and his family and wants the perpetrator to be punished as severely as possible. The cultural factor of the victim's family does not support the settlement of cases outside the court or peace.

To date, South Africa’s criminal justice system has been about crime and the punishment of offenders, and not about redress for crime victims. This can be ascribed to the nature of a criminal system that perceives crime to be a matter between the State and the accused, with the victim playing the marginal role of a witness. The retributive nature of our criminal justice has played a crucial role in the marginalization of the very person who was victimized, namely the crime victim. A number of countries have recently developed practices of restorative justice and therapeutic jurisprudence that have introduced an all-inclusive justice system that allows for participation by offenders, crime victims, their family members, the community and the State. Sadly, our country has been but tentative in its acceptance of restorative justice processes, with only a few thousands of individuals having benefitted from it since its inception. Although restorative justice is acclaimed as a system that allows for meaningful participation of victims in criminal processes, the author argues that the system favours mostly offenders, young offenders in particular, and is applied in respect of minor offences. For serious crimes, courts have been reluctant to embrace restorative justice processes, preferring to revert to the retributive system which is believed to have failed in reducing the crime rate in any country. In this article the author develops the idea that a lukewarm reception of restorative processes is detrimental to the administration of justice. It defeats the very purpose of victim involvement in the criminal justice system, and deprives the crime victim of the very benefits restorative justice is acclaimed for, namely healing and satisfaction.

In the UK, Australia, and further afield, restorative programmes have been developed as a response to the failure of the criminal justice system to give victims of sexual violence a voice in the legal process. The restorative justice literature has tended to focus on sexual offences perpetrated by adults and the importance of being victim centred. When it is a child or young person (CYP) who sexually harms, it poses a unique set of challenges for law and society and the restorative practitioner. This article explores the reasons why a different approach may be warranted given the perceived failure of conventional criminal justice in addressing the growing problem of child and adolescent harmful sexual behaviour (HSB) in Scotland. It discusses the difficulties with balancing the rights of the victim with the CYP who perpetrates the HSB and considers the challenges encountered by practitioners in the implementation and application of restorative programmes in HSB cases involving CYP. Although the evidence supports a growing need for a different approach, and restorative justice may offer just that, problems with net widening, the referral process, and resistance from other professionals and victim advocacy groups present real barriers. Consequently, restorative practitioners are likely to find practising in this area more challenging due to a lack of support and cooperation.

Karena secara konseptual keadilan restoratif berisi gagasan dan prinsip yaitu membangun partisipasi bersama antara anak, korban, serta kelompok masyarakat untuk menyelesaikan suatu peristiwa atau tindak pidana. Mendorong anak bertanggung jawab terhadap korban atau peristiwa atau tindak pidana yang telah menimbulkan cedera atau kerugian terhadap korban, serta membangun tanggung jawab untuk tidak mengulang lagi perbuatan pidana yang pernah dilakukan. Konsep keadilan restoratif juga menempatkan peristiwa atau tindak pidana tidak terutama sebagai suatu bentuk pelanggaran hukum, melainkan sebagai pelanggaran oleh seseorang (sekelompok orang) terhadap orang (sekelompok orang). The purpose of this article is to formulate the concept of restorative justice which balanced to protect between child offenders and the victims through the diversion (Victim-offender oriented). This goal will be realized through normative research (legal research) based on Restorative Justice concept.  In Law Number 11 of 2012 concerning the Child Criminal Justice System the process (SPPA Law), its prioritizes the Diversion Process (Settlement outside the court) carried out through a Restorative Justice approach. Article 5 paragraph (2) of the SPPA Law states Restorative Justice is the settlement of criminal cases by involving perpetrators, victims, families of perpetrators /victims, and other related parties to jointly to find a fair solution by emphasizing recovery and not based on revenge. Empirical conditions show that balanced legal protection between criminal offenders and victims has not implemented. Evaluation of Law Number 11 of 2012 is needed to formulating the Integrated Child Criminal Court.

The background is by two law applications that apply in Aceh, the first law that generally applies in Indonesia and the second one that applies specifically in Aceh, the Law Number 11 of 2012 concerning the System Juvenile Criminal Court is a way out for better handling of children conflict with the law. The law regulates diversion where there are two important things that have a special place in the SPPA Law, namely restorative justice and diversion. The results showed that the resolution of the problem of children conflict with the law in Aceh consists of two legal applications, starting with the mediation process according to Aceh Qanun Number 9 of 2008 concerning fostering customary life and customs Development with the aim that these problems can be resolved amicably according to the Decree Joint between the Governor of Aceh and the Aceh Regional Police and the Aceh Traditional Council No 189/677/2011 dated 20 December 2011 concerning the Implementation of the Gampong and Mukim Adat Courts, but if during the mediation process no agreement is found then proceed to the legal process according to the Law Number 11 of 2012 concerning the Criminal Justice System for Children.

The research objective is to identify and analyze the implementation of Diversion in order to realize Restorative Justice in the Juvenile Criminal Justice System in an effort to provide legal protection for child criminal offenders. The approach method used in this research is normative juridical or library law research or doctrinal law research, namely legal research by examining library materials and secondary materials, the results of the study found that the obligation to seek diversion with the Restorative Justice approach at every stage in the criminal justice process Children must be carried out in the Criminal Justice System, Diversion as a step towards transferring the settlement of children's cases from the criminal justice process to non-criminal justice processes by prioritizing the Restorative Justice approach which can be carried out by way of deliberation or mediation which emphasizes efforts to restore back to its original state in a friendly manner.

Although the crime of homicide has received significant attention from scholars, little research exists that examines the impact of homicide on surviving family members. Because opportunities for victims and family members of victims to participate in the criminal justice system are increasing, it is important to understand the impact of these forms of participation on those who choose to participate. This study uses data from focus groups to examine the experiences of homicide survivors within the criminal justice system, including views about how system involvement and specific outcomes (i.e., sentencing) may help or hinder healing. Findings suggest that many families leave the criminal justice system feeling marginalized and revictimized. This study calls into question the current criminal justice system’s ability to meet the needs of crime victim and their families.

The Child Criminal Justice System in practice, the child as a victim of sexual violence does not always feel its justice being reversed because the diversion process involving the community, the police, the social department, and the parties concerned does not always have a victim's perspective. The absence of a victim's perspective in resolving the issue of sexual violence through diversities makes restorative justice incapable of restoring and fulfilling justice for child victims of sexual violence compared to the criminal justice system in general because diversity is unable to bridge the gap between the challenges faced by victims and the help available to victims. Legal protection of child victims of crime, especially crimes against morality, with child offenders under the Criminal Justice System which must prioritize the approach of Restorative Justice by guaranteeing the rights of child victims to the efforts of medical rehabilitation and social rehabilitation both inside and outside the institution; assurance of safety, whether physical, mental, or social; and ease in obtaining information about case development through diversion. Sistem Peradilan Pidana Anak pada praktiknya, anak sebagai korban kekerasan seksual tidak selalu merasakan keadilannya dikemalikan karena proses diversi yang melibatkan masyarakat, polisi, departemen sosial, dan para pihak terkait tidak selalu memiliki perspektif korban. Ketiadaan perspektif korban dalam penyelesaian permasalahan kekerasan seksual melalui diversi membuat keadilan restoratif tidak mampu mengembalikan dan memenuhi keadilan bagi anak korban kekerasan seksual dibandingkan dengan sistem peradilan pidana secara umum karena diversi tidak mampu untuk menjembatani jurang antara tantangan yang dihadapi oleh para korban dan pertolongan yang tersedia untuk para korban. Perlindungan hukum terhadap anak korban kejahatan, khususnya kejahatan terhadap kesusilaan, dengan pelaku anak menurut Sistem Peradilan Pidana Anak yang wajib mengutamakan pendekatan Keadilan Restoratif dengan memberikan jaminan hak anak korban terhadap upaya rehabilitasi medis dan rehabilitasi sosial, baik di dalam lembaga maupun di luar lembaga; jaminan keselamatan, baik fisik, mental, maupun sosial; dan kemudahan dalam mendapatkan informasi mengenai perkembangan perkara melalui diversi. DOI: 10.15408/jch.v5i1.6575
