<p align="center">Abstraksi</p><p>Indonesia merupakan Negara hukum. Hukum bertujuan untuk menciptakan perdamaian dan ketentraman dalam kehidupan bermasyarakat. Tetapi dalam kenyataannya banyak sekali penyelewengan yang terjadi di masyarakat. Salah satu contohnya yaitu kasus kejahatan dalam berumah tangga. Kekerasan Dalam Rumah Tangga (KDRT) sebenarnya telah diatur dalam Undang-Undang Nomor 23 Tahun 2004 yang mengatur tentang penghapusan kekerasan dalam rumah tangga. Kejahatan rumah tangga yang paling merusak keutuhan rumah tangga salah satunya yaitu kasus <em>marital rape.</em> Sedangkan dalam Undang-undang Kekerasan Dalam Rumah Tangga (KDRT) belum mengatur khusus tentang atau masalah <em>marital rap</em><em>e. </em>Ada cara yang sangat membantu untuk mengatasi masalah <em>marital rape</em> yaitu dengan metode pendekatan <em>restorative justice</em>. Dengan pendekatan model ini, maka masalah <em>marital rape</em> akan terpecahkan karena tujuan dari model <em>restorative justice</em> ini mengutamakan suatu keadilan dan pemulihan masalah tanpa jalur pidana. <em>Restorative justice </em>akan berhasil dilaksanakan di masyarakat jika memperhatikan<em> </em>norma-norma yang ada di masyarakat terkhusus Norma Hukum. Untuk itu, dibutuhkan sosialisasi tentang <em>restorative justice</em> di kalangan masyarakat agar pelaksanaan <em>restorative justice</em> bisa menyelesaikan kasus <em>marial rape</em> di indonesia. Penyelesaian kasus <em>marital rape</em> dengan metode pendekatan <em>restorative</em> <em>justice </em>dapat berupa memberikan solusi dengan konsultasi psikologi, jika cara<em> </em>tersebut belum berhasil, bisa menggunakan cara hukum, dimana korban bisa menggugat cerai si pelaku, dan jika si korban mengalami kekerasan fisik yang dilakukan pelaku, korban bisa mendapatkan bantuan medis.</p><p> </p><p align="center"><em>Abstract</em><em> </em></p><p><em>Indonesia merupakan Negara hukum .</em><em>Indonesia is a Nation of law. The aim of law is to create  peace and tranquility in social life. But in the reality  many  once  misappropriation that occurred  in  society. For instance in case of crime in household. Domestic Violence (KDRT) actually has arranged in  Constitution  Number 23 of 2004 that governing abolishment  violence  in  household. One of the most factor which demage households integrity is case in marital rape. While in  Constitution Domestic Violence (KDRT) there is no special regulation yet against marital rape. There is  a really helpfull way to resolve marital rape with approach  restorative justice method.  With  approach this model, then  problem  marital rape  will solved  because  aim  of this restorative justice model give priority  for a  justice  and  recovery  problem  without criminal law. Restorative justice will successful held  in  community  if  pay attention  norms that exist  in  community  especially the Legal Norms. Therefore socialization about  restorative justice are needed  in  circles  community for implementing  restorative justice in order to solve  case of  marital rape  in  Indonesia. Settlement  of marital rape  with  restorative  justice</em><em> approach</em><em>  </em><em> method  could actualized through  psychology consultation, if  that way not successful yet, the victim could take litigation way, where she could divorce the perpetrator, and  if the victim has experience Physical violence by perpetrators, the victims  could acquired medical aid.</em></p><p><em> </em></p>

Various violations on human right happening in Indonesia today have never been completely solved. Victims of human right violations (direct or indirect victims) find it difficult to access justice through the existing criminal law today. Difficulties in proving the violations committed by the actors make it harder for the justice to be in the victim’s side. For any reasons, the violations of human rights should be brought into the court. It is surely not easy to do so as the retributive justice applied so far has not been able to solve the existing problems and to give fairness to the victims. Restorative justice is therefore considered as a potential way out for a justice to take place for the crime actors, victims and society in general. In various types of criminal actions such as domestic violence, law –violatingchildren and traffic crime, the restorative justice has been successfully applied and it is now under evaluation in human right related cases. This is done in order to find out the effectiveness of this restorative justice in solving those cases. This writing aims to find out opportunities for the restorative justice implementation in solving human right violations in Indonesia. Restorative Justice adalah merupakan suatu bentuk model pendekatan baru dalam penyelesaian perkara pidana. Model pendekatan restorative justice ini sebenarnya telah digunakan dibeberapa negara dengan fokus pendekatannya kepada pelaku, korban dan masyarakat dalam proses penyelesaian kasus hukum yang terjadi diantara mereka. Walaupun model pendekatan ini masih banyak diperdebatkan dalam tataran teori oleh para ahli, namun dalam kenyataannya tetap tumbuh dan eksis serta mempengaruhi kebijakan dan praktek hukum di banyak negara. Permasalahan dalam penelitian ini yaitu bagaimana mekanisme penerapan pendekatan restorative justice dalam penyelesaian kasus hukum di Indonesia dan bagaimana konsep restorative justice dapat menjadi bagian dari pembaharuan hukum pidana di masa yang akan datang. Dengan menggunakan metode penelitian deskriptif analitis dan bersifat kualitatif, dapat disimpulkan bahwa Indonesia dengan angka kejahatan yang relatif tinggi, patut pula untuk dipertimbangkan model restorative justice ini menjadi bagian dari pendekatan dalam penyelesaian kasus-kasus hukum yang terjadi selama ini. Dalam perkembangannya prinsip restorative justice sudah diintrodusir melalui sejumlah ketentuan dalam RUU KUHP dan diversi terhadap anak, terutama untuk memberikan keseimbangan perhatian diantara stakeholders hukum pidana (pelaku, korban, masyarakat dan negara). Tentunya, model pendekatan ini diharapkan dapat menjadi bagian dari pembaharuan hukum pidana Indonesia di masa yang akan datang guna mencapai keadilan, kepastian dan kemanfaatan sebagai tujuan dari hukum itu sendiri.<p>Restorative justice is a new approach model to solve criminal matters. Restorative justice model is an approach that has actually been used in several countries with focus its approach to offenders, victims and the community in the process of settlement of legal cases that have happened among them. Even though the model has still been widely debated in the level of theory, but in fact, it still grows and exists, also influences policy and practice of the law in many countries. Based on the reasons, the focus of this study, namely: How is a mechanism of a restorative justice approach in solving legal cases in Indonesia? How is the concept of restorative justice that can be a part of the reform of criminal law in the future? The research applies descriptive analysis study and uses qualitative method. The result of the study shows that Indonesia as a law state with criminal figures relatively high ought also to be considered that the model of restorative justice may become an approach for solving legal cases. Restorative justice principles in development have already been introduced through a number of provisions in the Criminal Code Bill and diversion of children, especially to provide a balance among stakeholders in criminal law (perpetrators, victims, community and nation). Of course, this model is expected to be a part of the Indonesian criminal law reform in the future to bring justice, certainty and expediency as the purpose of the law itself.</p>

The purpose of this study was to determine the criminalization law of nusyuz behavior both in Islamic law and the Criminal Code, and to know the relevance of Islamic law with the Criminal Code and Law No. 23 of 2004 in criminalization law of nusyuz behavior. The study used juridical normative approach in order to find the principle or the doctrine of positive law relevant to the issues studied, such as the opinions and ideas of jurists on the criminalization of the nusyuz behavior. This study used literature research method, which is a research conducted with data resources obtained from books or other writings relevant to the subject matter. The sources drawn from various works that discuss the problems of the family, the rights and protection of women, domestic violence and some literature on criminal law from the perspective of Islamic law and positive law. From the study, it can be concluded that: First, under the Islamic law, any form of physical violence against the wife is categorized in the form of jarimah (a criminal act) which is regulated in Islamic criminal law (fiqh jinayah). Second, in a substance, criminal law of physical violence against wife in the Domestic Violence Act is part of jarimah, a criminal act besides the soul. According to the Islamic criminal law, criminal act is classified into jarimah takzir.

The aim of this research is to know how the regulation of marital rape in Indonesian Criminal Law and Islamic Law. Marital rape or also known as rape in marriage still belong to such a debatable and taboo topic, but in fact it has happened a lot in society. In Indonesian Criminal Law, marital rape is not regulated in the Criminal Code. The Law on the Elimination of Domestic Violence regulates this as a complaint offense by calling the crime of sexual violence. In Islamic Law, marital rape is regulated in a good way by terms of husband and wife intercourse, among others in Surah An-Nisa Verse 19 which prohibits having to do with coercion. Refers to these results of the comparison, similarities are found in both Indonesian Criminal Law and Islamic Criminal Law that said marital rape is prohibited. The differences lie in the form of complaint offense between these laws. Islamic Criminal Law does not explain clearly about the complaints offense as known on Indonesian Criminal Law. Yet this law comprehensibly prohibiting the marital rape itself. For the further regulations of criminal law policies, it should take the principles of discrimination into account and the good boundaries regarding marital rapes, criminal liability, criminal threats and formal criminal arrangements either.

The aims of the study is to find out the law enforcement against perpetrators of domestic violence in terms of legislation and islamic law. this research was conducted by examining library materials or secondary data relating to divorce on the grounds of domestic violence. Furthermore, using a normative juridical approach, it is intended to get clarity about divorce on the grounds of domestic violence. The result shows that the criminal law policy in the formulation of a system of criminal sanctions against perpetrators of a crime in domestic violence according to the provisions of the Domestic Violence Act (UUPKDRT) uses an alternative formulation system type. Criminal sentences in the form of imprisonment or fines with minimum and maximum rules. In Article 44 (physical violence), Article 45 (psychological violence), and Article 49 (neglect) there is no stipulation of a criminal minimum limit that only mentions a maximum limit

The trend of violence against women in Nigeria has increased more than ever recently, with many women having been deprived of their fundamental rights. Violence against women in Nigeria includes sexual harassment, physical violence, harmful traditional practices, emotional and psychological violence, and socio-economic violence. This article investigates cases of domestic violence against women in South West Nigeria by assessing the role of family courts in the adjudication of such cases. Both primary and secondary sources of data were employed to examine incidents of violence against women and the role of the family courts in ensuring justice. The author employed both primary and secondary sources of data; the data gathered were analysed by frequency and simple percentages, while qualitative data were descriptively analysed. The article reveals the causes of domestic violence against women to include a cultural belief in male superiority, women’s lack of awareness of their rights, women’s poverty owing to joblessness, men seeking sexual satisfaction by force, women having only male children, the social acceptance of discipline, the failure to punish the perpetrators of violence, the influence of alcohol, and in-laws’ interference in marital relationships. It also reveals the nature of domestic violence against women. The research revealed that the family courts have played prominent roles in protecting and defending the rights of women. The author therefore recommends that the law should strengthen the family courts by extending their power to penalise the perpetrators of violence against women.

The article presents the results of a study of the problems of criminal legal assessment of criminal attacks on the health care system during the COVID-19 pandemic. The social background of such crime and its criminological characteristics are studied. Given the fact that most of criminal law, aimed at preventing crime, reducing the capacity of the state in the fight against novel coronavirus infection treated in depth by the legal and regulatory framework is impeding the spread of the pandemic COVID-19, and analyzed Federal laws, decrees of the President of the Russian Federation, decisions and orders of the Government of the Russian Federation, orders of the Ministry of health of Russia and other state bodies governing the functioning of public authorities, medical institutions and organizations, the rights and obligations of citizens and legal entities, this includes measures for the prevention of this disease in various areas of social life that are additionally regulated during the COVID-19 pandemic. The task of optimizing the criminal law provision of health care during the COVID-19 pandemic is formulated, taking into account the actual situation with the spread of this infection and the practice of countering it. As part of this task, based on a critical analysis of existing approaches in the science of criminal law, we formulate our own concept of crimes that infringe on the health system during the COVID-19 pandemic, characterize the problem, study their legal and social nature, and systematize such crimes. On the basis of the obtained data, a General description of crimes that encroach on the health system during the COVID-19 pandemic is given, their criminal-legal features are considered, theoretical approaches to determining their essence are studied, and the author's position on this issue is formulated. The author's classification of crimes that hinder the provision of health care during the COVID-19 pandemic is given. Groups of such crimes are consistently considered. A General description of their objective and subjective characteristics is given. Proposals for improving the interpretation of the relevant criminal law norms in science and law enforcement practice have been developed, and suggestions for their improvement have been substantiated and formulated. The article is addressed not only to scientists and practitioners of law enforcement agencies, but also to doctors who often work in conditions of a lack of legal knowledge about their rights and obligations, the qualification of certain acts from the point of view of criminal law, the grounds and limits of criminal liability for those that constitute a crime, and algorithms for actions in case of detection of such acts.
